Utah MONARCH I ON COURSE By Larry Wilcox LETS BE FOR knows I mM The Constitution of the United States, as originally conceived, in 1787 was ratified as the supreme law of the land. Since that time thousands of laws and several amendments have come into being which violate the original constitution. The only conclusion that can be drawn is that those who wrote and signed the laws and those who ratified the amendments violated the oath they took to preserve and protect the Constitution. It would seem imperative that a concerted move should be made to abolish these unconstitutional laws and amendments". Recently I asked a friend and colleague this question: Which ruling do we follow when one Supreme Court reverses a prior He ruling by its predecessor? answered, We follow the most recent ruling. It seems to me that this attitude makes our government a government of men instead of a government controlled by the Constitution. If constitutionality depends on the arbitrary will of nine men in black robes in Washington, D.C., the government of the United States consists at any point in time of those same nine men. In 1895 the Supreme Court declared that the income tax was If it was ununconstitutional. constitutional in 1895, it is still unconstitutional in 1976. The 1895 Supreme Court recognized the impossibility of instituting an income tax without violating the fourth and fifth amendments. Since it is impossible to police a direct tax such as the income tax without our servants in government gaining access to our business and private financial papers and without our testifying against ourselves, it is impossible to collect an income tax without first removing the fourth and fifth amendments to the Constitution. This has never been done. It has never been done because their removal would make us into a police state overnight. However, the same result has been created through the voluntary filing of income tax returns by citizens and the auditing of those returns by our servants in the infernal, unconstitutional, communistic Revenue Service. Obedience to unconstitutional is law obedience to the law of Satan which is based on aggressive force. When Daniel was faced with this problem Daniel refused to obey and the Lord protected him. When the mother of Moses refused to obey Pharaoah, the Lord protected both her and her son. Today our taxes are used to commit murder through abortion. They are also used to commit treason through foreign aid and to commit theft through the illfare system. Is it just possible that we who pay for these crimes are accessory thereto and ad accessories we must pay the penalty for the crime to which we acquiesce through the payment of those taxes? Obedience to unconstitutional law is evil. The practice of evil is sin and the wages of sin is death. (Romans 6:23) If all seems so hopeless to you. hope less, work harder, and pray more. with Capt. Joe H. Ferguson THE LIBERTY AMENDMENT Captain Joe H. Ferguson WHY THE LIBERTY AMENDMENT? The author of the Liberty Amendment, Willis Stone, recently spoke to a full audience at the Freemen Institute in Salt Lake City. He explained the gigantic problems now facing the American people and caused by excesses of their own government inflation eroding the purchasing power of their currency, overregulation of inand operated industries, dustry, government-owne- d a operated (at loss, of course) in competition with industries, foreign aid to communist countries, and a declining standard of living caused by the combination of rising taxes and inflation. With the financial condition of the federal government going rapidly the way of New York City, more and more people are beginning to realize what Willis Stone has been saying for 25 years we got troubles! Most of the major problems facing Americans today, explained Mr. Stone, are caused by excessive government controls and spending at the federal level. The way to solve these problems, then, is to eliminate the controls and reduce the spending. tax-payi- ng WHAT IS THE LIBERTY AMENDMENT? The Liberty Amendment is a proposed amendment to the Constitution of the United States which would eliminate unnecessary bureaucracies which overregulate the economy and greatly reduce needless spending as well. It reads: The Liberty Amendment "Sec. 1. The Government of the United States shall not engage in business, professional, commercial, financial or industrial enterprise except as specified in the Constitution. "Sec. 2. The Constitution or laws of any State, or the laws of the United States shall not be subject to the terms of any foreign or domestic agreement which would abrogate this amendment. "Sec. 3. The activities of the United States Government which violate the intent and purposes of this amendment shall, within a period of three years from the date of the ratification of this amendment, be liquidated and the properties and facilities affected shall be sold. "Sec. 4. Three years after the ratification of this amendment the sixteenth article of amendments to the Constitution of the United States shall stand repealed and thereafter Congress shall not levy taxes on personal incomes, estates, and for gifts." Now, if you will take a little time to analyze the above, you will see the Liberty Amendment packs quite a wallop. It would result in a drastic change in our federal government. Not only a drastic change but a drastic reduction in size. And that is exactly what a lot of people are beginning to realize is going to be necessary if we are going to avoid the same fate, nationwide, as New York City.
