An antimotorcycle helmet amendment, which Senator Jake Garn and vigorously supported, The today passed the Senate 7. amendment, which was attached to the Federal-Ai- d Highway Act of the Federal 1975, prohibits government from terminating a State's highway safety funds because of the States refusal to enact a helmet law. I had earlier joined in sponsoring a bill which would have accomplished the same thing, so I am pleased the amendment passed. Senator Garn said. The threat to terminate federal financial assistance because of with federally imposed standards is a severe sanction that I feel we cannot tolerate. Local governments are being harassed by the Feds on several fronts and the threat to withhold needed funds is the worst possible kind of harassment. As I have said many times before, it is not possible for the Federal government to know in every instance what is best for all or any units of local government. If the Utah State legislature thinks the State needs a helmet law, they should be free to pass it; if they feel it is not necessary, they should be free to reject the plan without fear of federal retribution. Compulsory helmet laws are also an encroachment on the rights of the individual.
