Khruschev addressed the Lnited Nations on the subject "General Complete Disarmament." Of course he meant disarmament for all nations except the USSR, but he did net say that. Nevertheless many American leaders seem to have acted on that assumption. The following year at the Asilomar Conference Grounds in Monterey. California, Mr. Paul Nitze advocated a plan for scrapping 90 percent of our nuclear power and surrendering the other 10 percent to the Lnited Nations. He further advocated oartiaiiv sur- rendering our military power to less powerful countries o we would no longer have superiority. For that reason or some other, he was made instructor at the War College, and later Assistant Secretarv of Defense for International Security Affairs, and still later. Secretary of the Navy under President Johnson. This was in line with a policy that was popular in Washington some years earlier. Among others, it was advocated by former Secretary of Defense McNamara. I he atom bomb was said to be too powerful to be the property cl only one nation, and that we. therefore, must share it with other nations because we could not tiust ourselves. If we cannot trust ourselves, what leads any of us to believe that we can trust the Kremlin? At any rate, this type of thinking is what led to the dhiusion of the knowledge of how to make the atom b mb. I nat s the reason why we deliberatesimparted this information to the USSR. At the close ol World War II we were incomparably stronger than all other nations of the world put together. We might have imposed a Pax Americana similar to the Pax Britannica that lasted 100 years, or the Pax Romana. that lasted much longer. But instead of so doing, we chose to reduce our strength to the level of other countries and to impart to them full information about how to make the atom bomb. He refused to permit the accused to lay his defense before the jury, or explain the factors which created a state of mind in which refusal to file a 1040 could not be One defense adjudged willful. witness was not even permitted in As soon as the courtroom. another who qualified as an expert on the monetary question was sworn and identified, the judge announced that he would not be permitted to testify for the defense, but he permitted the prosecution to question him at will. If there was ever a trial in which the verdict should be reversed because of the way it was conducted, this was it. Ellsworth was scheduled for sentencing on November 24. Judge Carl Muecke. obviously under terrific pressure, told the accused that he would defer sentencing until the 26th; and offered probation for a change of attitude, a promise in the future, and to file an assurance that he would knuckle under to the Internal Revenue Service. After the judge left the bench and the courtroom was cleared, there was a call to return: and the judge told Mr. Ellsworth jury-manipulati- tax-retur- ns that he had received a com- munication from the church of which Vaughn has been a devout member all his life, stating that the Supreme Court has declared the income tax constitutional: that changes in it should be accomplished through legislative action: and that illegal rebellion against it would be subject to discipline by a Church court and from Church minisMr. trations. Ellsworth was told to think all this over very carefully and to appear on the following Wednesday morning with his answer. The judge kept repeating that he was doing the accused a great favor. Vaughn was at my house that evening: and that he was undergoing a fierce mental struggle was obv ious. He told me that w hat his Church said was far more important to him than what the United States government says or demands. I told him. in effect: Vaughn. 1 cannot tell you what to do: it must be your decision, and yours alone. But remember that you must spend the rest of your life living with it. At 9:30 A.M. November 26 I met him in the Federal Building. What have you decided? He wrung my hand: Im going to tell the judge that what I did was right. Vaughn. I said, you will go down as one of the bravest patriots in America. At the hearing, which lasted more than three hours. Vaughn asked for a new trial and that the government pay for a trial transcript and an attorney of his own choice. The prosecutor even wanted to know the names of all persons who had contributed any money for his defense! The judge denied the motion for a new trial; however, he granted the motions in regard to the transcript and the attorney. So that was a victory' so far as it went. Then the judge wanted to know if he still held to his old opinions concerning the income tax law. Ellsworth replied that he was no criminal and that he could not change his position. The prosecutor then made a long plea, in which he declared that the government had the best case against Ellsworth it could ever have against anyone; and that if he were to escape a prison sentence, then no one could be sent to jail for disobeying the law. Ellsworth was then sentenced to pay a fine of S2.000 (S500 for each of four counts) and to serve four three-yeconcurrent prison But was no bail and no there terms. appeal bond. We should note that in his fanatic fervor, the judge did not even seem to know what he was doing. Three of the counts were misdemeanors, which under Section 7203 of the Code, provide maximum penalties of one-yeprison terms. How. then, could these be increased to three years each except through unbelievable ignorance? Furthermore, count one. which was for fraud, was a trumped-u- p charge which should have been handled simply as a civil case, not a criminal one.
