Coal Mining Constitutionality of w, West Virginia Statute Penalty. Section 7 of chapter 79 of the Code of West or Virginia is as follows: No ownercoal tenant of any land containing shall open or sink, or dig, excavate or work in any coal mine or shaft, on such land, within five feet of the line dividing said land from that of another person or persons, without the consent, in writing, of every person interested in, or having title to, such adjoining lands in possession, reversion, or remainder, or of the guardians of any such persons as may be Infants. If any person shall violate this section, he shall forfeit five hundred dollars to any person injured thereby who may sue for the same. Dissolution-Not- ice Mining Partnership to Employees Liability of Partner for Wages One who was employed by a mining firm, and who had no notice of a deed of the mining property to a corporation, can recover of the partners for services rendered after the execution of the deed, though he admitted that he heard that a corporation had taken charge of the mine; it appearing that one of said partners continued to act as superintendent of the mine, and that he stated that he did not remember having ever notified such employee of the change in the ownership of the mine. When a mining partnership conveys all its property to a corporation, such partnership is thereby necessarily and wholly dissolved. Dellapiazza vs. Foley, 44 Pac. Rep., 727.
