All the evidence was in and both ides rested at noon Tuesday, when County Attorney W. W. Maughan and City Attorney P. EL Keeler addressed the Jury in behalf of the state, and Attorneys A. B. Irvine and Capt. Wbdge-woo- d spoke for A. M. Clayton. Shortly before I p, m Judge Thurman for the defense asked the court to adjourn unless his honor desired to hold a night cssion. Juror Campbell made a plea for a night session, so that the case could be terminated and the Jurors released. ButJudge Hart adjourned the hearing until 1a.m. On resuming Judge S. M. Thurman, leading counsel for the defense, occu- -. Pled an hour's time In an eloquent appeal to the Jury, presenting Mr. Clay-ioaide In a masterly manner. District Attorney Frank K. Nebeker dosed for the state and In forceful and vigorous language 'arraigned the defendant and claimed that the state had Proven conclusively that Amasa M. Cfeyton guilty as charged. Attorney A. B. Irvine also spoke for the defense. The court room was well filled with the friends of both sides, and as the court charged the Jury to retire and carefully elgh the evidence, and to give the defendant the benefit of the doubt, the rowd dispersed to express a wide divergence of opinion aa to the probable verdict the Jury would bring In. After deliberating for nearly eleven tours the Jury at 20 minutes to 10 p. m. brought In a verdict of guilty with recommendation for mercy. It was learned that three Jurymen tood out for acquittal, but were final iy won over to the majority. It Is not likely that the case will be PPealed, as the defendant, it Is said, fechs the necessary means to fight the e further.
