Show Friday, February Sun Advocate, 27, 1981 Price, Utah 3 Assault case is moved A Helper man was bound over to Seventh District Court Wednesday to face charges of aggravated sexual assault and attempted murder in the first degree. Vernon Reese Evans, 51, is charged in connection with the Sept. 9, 1980 assault of a 13 year old Price girl and the attempted murder of her mother. Circuit Court Judge A. John Ruggeri of the 11th Circuit Court moved the charges to Judge Boyd Bunnells Court for an arraignment at 9 : 30 a .m. , March 9 . At the preliminary hearing Wednesday, the girl contended in her testimony that: She was feeding horses near her south Price home when a man drove into the field in a pickup truck. The man grabbed her by the neck and pointed a gun to her head. She contended the man then told her to undress and verbally threatened to shoot her. She then screamed rape and the man grabbed her mouth. She also kicked him in the face twice. During the assault her mouth was bruised and her groin area was injured. While she was on the ground the man placed the gun near her temple, at her face and about her stomach. During the assault the girl said she heard her mother tell the man to leave. The kneeling man then pivoted around and pointed the gun'at the mother. Her mother told her to get up and run. The girl put on her clothing, ran to a nearby home and phoned the -- police. While enroute she heard three gunshots. The mother contended in her testimony that: She had let her daughter go over to feed the horses before 6 p.m. She later became concerned since a man attempted to pick up her daughter near the house the previous day. In walking over to the grazing area she saw the truck which matched the description of the vehicle In which a man used in his attempt to pick the daughter up the previous day. In walking up to the horses she saw a man kneeling with a gun in his hand. She said she "instinctively" charged towards the man telling him to get away. When she was about eight feet away, the man turned, aimed the gun at her head and fired. Prior to the discharge she started to veer behind a hay stack. While picking up a pitch fork, she yelled to her daughter to run. She moved around the hay and attempted to knock the pistol from the man's hand. During the fight the man aimed the gun at her face and fired two more times. No bullets struck her. She was able to knock the man down with the pitch fork. During this fall the man lost his glasses. The man apparently attempted to shot at her again since she heard the hammer of the gun being pulled a couple times. During the fight, which lasted less than 15 minutes, the man was able to push the pitchfork aside and knock the mother down with the gun butt. At this point she lost her glasses. The man returned to his truck and attempted to leave. The mother got up, grabbed the pitch fork and went towards the truck which had become stuck in some weeds. The man then accelerated the truck towards the mother. She had to get behind a building to avoid being injured. The man then put the truck in reverse and left the scene. Both the mother and daughter contended that the man carrying out the attacks was Evans. Dahl said that he also wanted the murder charged attempted reduced to attempted manslaughter. Dahl said first degree murder requires a planned intention to murder. The testimony of the mother indicated that during the fight both parties were alternately trying to get away from each other. Dahl noted that in the mothers statement she believed that he was just as scared as she was. Dahl said this would indicate that the man in the attack was only reacting to his reflexes. Chiara said that didnt appear to be the case since the daughter said the man had threatened to kill her. The day after the alleged assualts Evans was arrested on the Airport Road. Neck injury A three car accident on Main Street Thursday netted an estimated $1700 damage to the vehicles and put one driver into Castleview Hospital.
