Currently she is employed at Robertson, Inc. in Wellington. Rory is a 1977 graduate of Emery County High School. After graduation he attended a year at Snow College. Board of County Commissioners of Carbon County in regular meeting assembled this 26th day of November, 1980, herein state the following amendment be made to Carbon County Ordinance No. 119 entitled: An ordinance establishing a transient room tax in Carbon County pursuant to the Provisions of Chapter 31 of Title 17, Utah Code Annotated, 1953, as amended. Amendment shall be made of Section 4 of said Ordinance, transient room, which section shall read as follows: Section 4 Transient Room. From and after the operative date of this ordinance, there is levied and there shall be collected and paid a tax upon all rent for every occupancy of a suite, room or rooms on all persons, companies, corporations, or other like and similar persons, groups or organizations doing business in Carbon County as motor courts, motels, hotels, inns or like and similar public accommodations, at the rate of three percent(3). Except as hereinafter provided, and except insofar as they are inconsistent with the provisions of the Chapter 31, Title 17, Utah Code Annotated, 1953, as amended, all of the provisions of Chapter 15, Title 59, Utah Code Annotated 1953, as amended and in force and effect on April 20, 1972, are hereby adopted and made a part of this ordinance as though fully set forth herein. Wherever and to the extent that in Chapter 15 of the Title 59, Utah Code Annotated, 1953, the State of Utah is named or referred to as the taxing agency, the name Carbon County shall be substituted therefor. Nothing in this subdivison shall be deemed to require substitution of the name of the County for the word State when that word is used as part of the title of the State Tax Commission, or of the Constitution of the State of Utah, nor shall the name of the County be substituted for that of the State in any section when the result of that substitution would require action to be taken by or against the county or any agency thereof, rather than by or against the State Tax Commission in performing the functions incident to the administration or operation of this ordinance. If an annual license has been issued to a retailer of the said Utah Code Anunder Section notated 1953, an additional license shall not be required by reason of this section. There shall be excluded from the rent paid or charged by which the tax is measured: ( a ) The amount of any sales or use tax imposed by the State of Utah or by any other governmental agency upon a retailer or consumer: (b) Receipts from the sale or service charge for any food or beverage or room service charges in conjunction with the occupancy of the suite, room or rooms. This Ordinance shall therefore be in full force and effect on December 26, 1980.
