Joint '1 enancy is a common method used to avoid probate. We have found, however, that few people really understand the consequences of holding property as joint tenants. Creditors. For example, by placing your property in joint tenancy with a son, your son now owns half of your property. The creditors of your son now can take your property to satisfy his debts. Any present or future medical bills, car accidents, divorce, bankruptcy and other potential problems of your son can now have a tremendous impact on your assets. Loss of control. Since your son now has equal interests with you in your property, you may have to obtain your sons permission if you want to sell your home or refinance it. Disinherit other children. You may have unintentionally disinherited your other children. Your son is not required to split the assets among any of your children after your death. Even if he wanted to fairly split the assets, his creditors, spouse, or others may not let him. Taxes. Other consequences of using joint tenancy may include need less gift, estate and income taxes. Proper Planning. Joint Tenancy can be an effective estate planning tool. Far too often, however, joint tenancy is used without understanding the potential traps involved or the alternatives that are available.
