For that service, every subscriber is charged $1 per month. ClearVision has been voluntarily carrying the service for two years. To date. Falcon has not agreed to carry the channel. "Falcon was given a period of two weeks following the Aug. 17 meeting to comply with the new agreement," Everett said. "When Falcon still did not sign, the City of St. George gave them 30 days to comply. Several 30 day waiting periods have passed since then. Falcon is in blatant opposition to the law. Without a signed franchise agreement, Falcon has no valid business license to operate in St. George," he said. Falcon Cable Manager Richard Renewickie said, "Falcon will sign the agreement on Jan. 30. I belong to and attend the Community Education Channel meetings. I look forward to the Community Education Channel taking affect here at Falcon." "My reservation with this agreement," Renewickie added, "is and always has been funding. The channel is commonly known as 'the College Channel' and my intention with the survey was to inform the public of the $1 monthly cost for funding a particular channel. I felt that the public needed to know that this was a thousand dollar issue just in St. George and just through Falcon customers." "I felt that a community channel means just that, community, yet the only people paying for it are the cable one-hundr- customers," Renewickie said. "The responses I got from the survey was enormous. I have 334 responses. These are not just the little clip out survey forms. Many of these letters are not just from Falcon customers, but from the general public and ClearVision customers as well. These are clearly from people who are concerned that they will not benefit from the service." Renewickie said he has two responses from people who want the service. "The customers who seem to be most distressed about the $1 are those homeowner association groups who will see a substantial rate increase for their cable service," Renewickie said. However, Renewickie said he is still anxious to see the Community Education Channel come into effect. Meanwhile, Everett said city officials have moved slowly and methodically and they may appear to be dragging their feet, "but the city feels that before they have the need to be heavy handed in enforcing the ordinance, they want to be sure of all the legal obligations and the ramifications of taking action." "The city has checked everything out thoroughly with a broadcast attorney consultant from Minneapolis. The city has been above board and more than fair," Everett said. "They have found they are completely within their legal rights to consider Falcon as operating a business without a valid business license in the City of St. George. The city has given Falcon every opportunity to comply." "Falcon seems to think that it is tire city's obligation to pay for the service of the Community Education Channel to the community, not Falcon's," Everett said. "Actually, it is the consumers who are paying for it." Everett believes one thing dissuading Falcon to sign the new franchise agreement is the change from the two percent franchise fee in the old agreement to the five percent fee in the new agreement. "Or maybe the concern Falcon representatives alluded to prior to now is that the Community Education Channel is a Dixie College project. We are the Community Education Everett Channel, KWC-TVsaid.
