IV Salt Lake Tribune, Bll July 24, 1965 Wednesday, Suspect in Triple Slayings in Cedar City Is Denied U.S. Writ By Joan OBrien Tribune Stall Writer The federal court cannot consider accused killer Norman Lee Newst-ed- t habeas corpus petition because he still has not exhausted the available state court remedies, a U.S. magistrate has found. tf.S. Magistrate Ronald N. Boyce, in report and recommendation filed Tuesday in U.S. District Court for Utah,; also said Newsted has not raised a legitimate federal constitu-tioaatclaiin his petition for a writ of hat)aas corpus. tyefsted may object to Judge BoyCsS ruling within 10 days. His attorney, J. MacArthur Wright, SL George, was not available for common Tuesday evening. Newsted, charged in the Cedar City triple slaying on Valentines Day 1984, filed suit in federal court last May claiming Utah officials lack jurisdiction to try him for murder. Newsteds attorney argued he was brought to Utah from Oklahoma, where he was convicted of another murder, under the Uniform Witness Act which grants him immunity from prosecution here. But Iron County prosecutors claim Newsted was brought to Utah under the Interstate Agreement on Detain he can be prosecuted. Newsted, SI. Las Vegas, was removed to Utah in August 1984 to testify at the trial of Douglas Edward Kay, S8, Las Vegas, also charged in the Valentines Day murders. Newsted came to Utah just weeks alter he was sentenced to die In Oklahoma for the February 1984 murder of a Tulsa cab driver. Once in Utah, Newsted was charged with the murders of waitress Patricia Frei, 23, Cedar City, and customers Robert Bull, S3, Cedar City, and Ronald Schmid, 24, Idaho Falls. By Jack Fenton t Tribune Staff Writer Richard Prows sees a conflict of lifestyles taking place across the Salt Lake Valley as homeowners battle to keep apartments out of their singlefamily neighborhoods. He discussed the problem with county commissioners, who have the final say in resoution of toning disputes, and members of the United Association of Community Councils, which reviews applications for son- - ing changes but usually backs at units being built or planned. "People are getting upset, Lynne Turner, president of the Taylorsville-Bennio- n Community Council, told commissioners in April. A former member of the county planning commission, shed asked commissioners for a pause in apartment house development to see just how fast those units can be absorbed. Double Holiday 10 Sisters Together for a Reunion Special to The Tribune AMERICAN FORK It has been more than 50 years since all 10 daughters of the Ralph Fullmer fambut this year ily of Springville have been together they are observing Pioneer Day with each other. Mrs. Curtis (Fay) Chipman, American Fork, said all of the sisters are over 50, and reside throughout the country. Mom always said to keep the family together by having reunions and we have a reunion each summer but this is the first time all the sisters have been ; able to come, Mrs. Chipman said. ; .Of the four boys in the family, three of them are also here for the reunion. " Mrs. Chipman said there is a different theme for the reunion each year. This year it was the pioneers, and, appropriately for July 24, all of the sisters wore pioneer costumes. She said some of the familys ancestors came across the plains in hand carts. John Solomon Fullmer came over on ship from Glasgow in 1738, settling in Pennsylvania, she said. He is survived by his widow, Carrie, three sons and one daughter. The family came west with the pioneers, and Mr. Fullmer was with Joseph Smith the night before he was killed. He was the most capable executive I have ever known, commented Paul Hunter, senior vice president, and president of Sunshines Precious Metals Division. John S. Fullmer Jr. was born in 1846 while the family was still in Nauvoo, 111. Upon coming to Utah, they were early settlers of Panquitch. The four boys in the family are Clay, Phoenix, Ariz.; Ralph and Mark, Provo; and Virl, American Fork. "One son plus mom and dad are deceased, Mrs. Chip-ma- n said. He and chief Executive Michael Boswell have been instrumental in bringing this company from a small operation to a medium-siz- e company, with assets now valued at 8750 million, in the last five years. Mr. Howard, a native of Texas, was an earth sciences graduate of the Massachusetts Institute of Technology and holder of a masters degree in geology from New Mexico Technical University. As an Alfred P. Sloan fellow, he later earned a masters degree in management from MIT. The family has suggested contributions to the Idaho Panhandle Council of the Boy Scouts of America, Hayden Lake, Idaho. One sister made a quilt which was to be given away at the reunion sisters said.
