in the territory proposed to be inctud ed within the area or by not less than 10 per cent of the taxpayers owning real property which is located in the territory proposed to be included within the area, that it specifies the types of extended county services to be provided, that it describes the boundaries of the proposed area with definiteness and certainty, that it appears to be in the form required by law and that it contains those matters and has been filed in accordance with Section 17 29 5, Utah Code Annotated, 1953, of the "County Service Area Act", and WHEREAS, the Board has determined to proceed with the creation and establishment of the proposed service area as requested in said Petition. proposed area as they are deemed necessary and desirable by the governing body thereof, (1) local park, recreation or parkway facilities and services, (2) a cemetery, (3) culinary or irrigation water service, and (4) sewers, sewage and storm water treatment for disposal The provision of such services and facilities may be by means of the acquisition, construction or installation of any facility or property, including water and water rights, required or necessary to supply the services specified herein, or any part or combination thereof, or for maintaining, repairing, improving and extending any such facility or property or combination tof facilities and property The acquisition of facilities, property and services may be by purchase, gift, lease, devise or bequest condemnation, any combination of the foregoing or by any other means available to service areas as provided by law The acquisition of facilities and property may include the appurtenances thereof and may be for partial or loint ownership interests in the prooerty acquired 4 A tax or taxes will be levied annually upon all taxable property within the service area or a service charge or charges will be imposed periodically upon the users of the authorized services to be provided within the service area or a combination of property tax or taxes and service charge or charges will be levied, imposed and collected as aforesaid which shall be sufficient to pay for all services furnished by 5 No part of the the service area on an extended basis proposed service area described herein is included within the boundaries of any city or town The proposed service area is located entirely within Salt Lake County, State of Utah 6 No territory included within the boundaries of the proposed service area is also included in whole or in part within the boundaries of any other county service area created pursuant to the provisions of Chapter 29, Title 17, U C A , 1953, as amended, nor of any other service area or improvement district created for the same purpose under any other statute of the State of Utah 7 It is proposed that the Board of County Commissioners, in the initial ordinance creating the service area, determine that the service area should be governed by a board of trustees as is provided fo in Section 1, UCA, 1953, as amended, and appoint the first board of trustees in accordance with the provisions of said Section 8 PUBLIC NOTICE IS HEREBY GIVEN TO ALL INTERESTED PERSONS THAT A PUBLIC HEARING on the creation and establishment of the service area proposed in this Resolution, constituting and consisting of 25 per cent of the qualified voters of the territory proposed to be included within the service area file written protests within thirty (30) days after the conclusion of the said public hearing against the establishment of the county service area or against the specified type or types of extended services within the area, the Board shall, in the former instance, abandon the proposed establishment of the service area, and in the latter instance, eliminate those types of services objected to from the ordinance finally establishing the service area A protest filed by a corporation owning property in the proposed service area shall be sufficient if signed by an officer or duly authorized agent of the corporation An aggrieved property owner or person qualified to vote who has filed a written protest within the time specified hereinabove may appeal as provided by law to the District Court in and for Salt Lake County from any decision of the Board of County Commissioners to establish the County Service Area 11 The County Clerk shall publish this Resolution in its entirety in the Tribune, a newspaper of general circulation published in Salt Lake County, said publication to be at least once a week during four consecutive weeks, the first publication of which shall not be more than sixty (60) days nor less than twenty-eig(28) da vs prior to the
