Show DISTRICT COURT TERM PROLONGED THROUGH WEEK With a couple of civil cases turning the trick, the 3d term of district court, which commenced last Monday morning, his stretched through the whole week, with a few features of the cases still to bi aired. In the criminal division the appeal case of the state vs. C. A. Franks was con.iuued for the term, as was the case of the state against Samuel McDaniels, Herbert Richards and June Anderson, the Cleveland boys accused of burglarizing burglar-izing the company store at Mohrland. Attorney Woods will represent the boys at the next term of court. The case of the state against Alfred Nichols, accused of grand larceny, was rather quickly disposed of, but only after af-ter a jury had buen secured and the state had produced its evidence, when the jury was excused from the room and King, representing the defendant, argued that a verdict of not guilty s ould be rendered at that time. The motion was not strenuously opposed by District Attorney Cherry and tn court accordingly instructed the jury to render ren-der a v. rJ.ct of not guilty which was done. Another jury was then selected for theci.il case of Tom Cholas vs. the Castle Valley Coal company. The case is one grow ng out of alleged breach on the part of the Company of contract for digging coal, which the plaintiff Cholas had entered into with tne company. com-pany. The case began Wednesday and dragged along very slowly, the use of an interpreter being demanded at times. Attorney S. A. King represented represent-ed the plaintiff and D. D. Houtz and Geo. M. Miller the defendant coal company. The esse was still pending as we went to press and there is still a quantity quan-tity of evidence to be introduced besides be-sides the trying of a counter claim for ?5W brought by the coal company for alleged damage in the shooting of root coal by Cholas' men. The next case that comes up will be that of W. T. Rawleigh Medical Company Com-pany vs. J. A. McKee, et al., an action brought to recover on account.
