Show SOUTHERN UTAH NEWS News Child pursues $12,000 claim The city of Kanab and some of its personnel received a Notice of Claim last week from a Salt prosecution MONDAY MAY 6, 1991 $12,000 in damages be paid to Child. The notice is the first step in a lawsuit Child plans to file in federal court, claiming his civil rights were violated when criminal mischief charges were prosecuted against him for nearly a year in connection with damage he allegedly did to the shoulders of Ranchos roads. The charges were dropped in January, but Child is claiming the city should at least pay his legal expenses. The Notice of Claim names the city of Kanab, Mayor Bemie Ripper, Police Chief Bill Blasdell, and City Manager Keith McAllister. Dan Goodsell of the law office ofKirton, McConkie & Poelman is representing Child. Goodsell explained the city is subject to governmental immunity, so there is a special administrative procedure that must be followed to sue the city. This Notice of Claim must be filed, then the city has 90 days to respond before a legal suit can be filed. The Notice says Child has inexcurred actual sum the in approximate penses of $12,000 including costs and attorneys fees. In an effort to avoid civil litigation, Mr. Child hereby demands reimbursement of the $12,000 of damages he sustained as a result of the malicious and wrongful prosecution alleged herein," the Notice says. The concluding paragraph under Statement of Facte says: The only reasons this groundless criminal action was instituted against Mr. Child was (1) so that City officials could acquire evidence in Mr. Childs possession showing the dangerous and deterioratingcondition of the Ranchos roads and (2) to punish, harass and inflict pecuniary loss on Mr. Child for his open criticism of the citys poor and negligent handling of the construction of the Ranchos roads.
