My letter, and I am sure, some of the other concern which lias been expressed, resulted from an item contained in High Lights, a newsletter published by the Garkane Power Association, Inc. SPECIAL SESSION OF UTAH LEGISLATURE Governor Rampton has called a special session of the Utah State Legislature for the week of June 23rd. One of the matters to be on the Agenda is S.B, No, 291, which involves water rights. A key provision of the bill is as follows: 8. Applications filed with the State engineer to appropriate water, whether filed before or after the effective date of tills act, shall not be entitled to any priority or preference over any other applications or any other potential future users of water by virtue of the date or dates when such applications by Ernest G. Kirby Haven't written for a while although Ive been urged to by a lot of friends especially those away from home who come back to Kanab once in a while really, nothing much liappens to me to write about about the most exciting tiling Is my daily walk to the postofflee and lying to my neighbors about my garden-guess I bragged too much about my growing food stuff because my potatoes promptly turned yellow like they had a bad case of Hepatitis and my tomatoes got theDropsy and thats bad with tomatoes at 89? a pound its no wonder that I find Rita out in the garden talking sweetly to the adolescent tomatoes at that rate, a bushel of tomatoes would cost over $50 ar bills and you could concoct a green salad out of cheaper than that and it would be about as tasty as the store bought variety Oh, well, if the wilt doesnt get the rest of the vines, the bugs probably will 89? a pound!!!!!!! 72-2-- one-doll- were filed. Careful review of the bill shows nothing to support such a statement. However, lacking a copy of the proposed legislation, reaction to the printed statement seems concerned and restrained, rather than historical. Recent events do not support logically an unconcerned faith in governmental action. 1 am enclosing a copy of the proposed bill, which I obtained from Governor Ramptons office which I hope you will print. I am also enclosing responses from the Governors office and from Senator Leavitt to my inquiries. The letter from the Governors office says, in part: A special session of the Utah Legislature has been called for two purposes, one being for the purpose of finding a mechanism to fund the continuation of Utahs highway maintenance program and two, for the purpose of passing legislation which win, for the first time in Utahs history, give the State Engineer guidelines on which he must approve or reject a water application. Presently under Utah State Statute, the State Engineer has the authority to app rove or disapp rove a water right application without any guidelines. The bill presently before the Legislature is amended to clarify the disposition of an unappropriated water right. There is no intention by the State of Utah to take away an existing water right which you, in good faith, have developed. we have a Unfortunately, number of unappropriated water rights in the State of Utah which are not assigned for any use, be it culinary, agricultural or industrial. It is unthinkable that an individual who has made a priority application for water can then turn around on the basis of his prior application and sell that unappropriated water to the highest bidder. Since you have a certificate of appropriation, such certificate would constitute prima facie evidence of your water right. The conference, sponsored by Commander Training t! a P r n 5 Command, was held June 1. As guests of Rear Admiral Allen E. Hill, Commander of the United States Pacific Fleets Training Command, the 75 look counselors got a first-han- d at the Navys recruit training, vocational instruction, and management orientation proconfergrams. The three-da- y ence also provided the counselors with tours of a number of the Navys schools, a look at recruits barracks and graduation ceremonies, and a sample of shipboard life with a visit to the USS DIXON and USS SPERRY both submarine tenders. The counselors were informed of the opportunities offered by the Navy to its members and the schools and training provided to make those opportunities happen. Depending on amendments, it may warrant the support, or defeat, of Utah citizens. W hether or not it is passed will surely affect to some extent, the economic and social future of Utah. I commend your effort to gain additional and timely information regarding the progress of the bill and helping to keep us informed.
