JANUARY 11 , 2001 I New SUUSA branch resolution g·o es to polls BY LEAH HARTMANN JOURNAL STAFF WRITER A sigh of relief made its way around the Senate chambers Tuesday night after the unanimous passage of a resolution creating a new body of student government. The resolution at the forefront of the Senate's collective mind since fall semester "has been much thought through," Academic Vice President Steve Nelson said. Resolution No. 004-00, sponsored by College of Science Sen . Timette McKenna , College of Perfonning and Visual Arts Sen . Jennifer Powell, and College of Business and Technology Sen. Jessi Allen will establish new leadership over Clubs and Organizations. · The resolution will create a new C&O vice president, and it will affect both C&O activities and funding . In open forum , three students including Rick Griffiths, a junior family and consumer science education major from Kearns , Utah, spoke in favor of the bill. As the C&O representative for Sigma Delta Omricon , Griffiths said the new body "puts smaller clubs in a better position for funding ." The lone voice of opposition to the new resolution was Hollie Donner, a senior English major from Greece, NY. She expressed her concern that students who are not members a club or organization will not "have a bona fide voice in front of the assembly." She said she did not have a better alternative but said "I feel strongly (about this) and am opposed to it on a fundamental level.· In a 'short discussion of the bill by the senators, Sen. McKenna said "(all) the students will be heard, and the main way to be heard is t1"1rough their senators.· She added, ·tiiiis (new body) allows a lot more voice than before." A general election will be Jan . 17 to approve the change to the SUUSA constitution . Pending approval by the stud~nts, the new resolution will be presented to the Trustees on Jan. 24 . Two other bills were passed Tuesday night. Bill No. 015-00 titled "Focusing on Science· was passed unanimously, as was bill No. 014-00, titled "Educators Get Smart ." "Focusing on Science,· sponsored by College of Scier1ce Sens . McKenna, Ryan Bell, and Kayce Hatch , requested $665 be allocated for the science focus days that will be held Jan. 30 to Feb. 1. These activities include presentations by professors and the Science Bowl. "Educators Get Smart," sponsored by College of Education senators Marcy Gubler, Danna Esplin , and Brianna Baumgartner, requested $989 be allocated for Education Days Events to take place Feb. 7-9. In addition to a free fajita bar dinner Feb. 7, members of the community will be able to get involved through workshops , Baumgartner said. The following is an excerpt from the SUUSA Senate Resolution No. 004-00 and the proposed changes to the SUUSA Constitution: A resolution 'from the SUUSA Senate proposing changes made to the SUUSA Constitution: Article IV, Sections 1, 5, 9, 10, 12, 13, 16 and 11', adding Sections 18-25; Article V, Sections 2, 5, 8, and 9, adding Section 10; Article VII , Section 1, adding sections 8 and 9; and Article VIII, Section 3. Whereas these changes will establish a new governing body to SUUSA that will be over all C&O activities, and funding, and ; Whereas these changes will eliminate the responsibility on the Senate to allocate funds to and oversee the C&O organization , and; Whereas these changes will allow all responsibility of the clubs and organization's funding and investigation to fall on the clubs and organizations themselves. Article V: • Section 2-The Executive Council shall consist of the following elected offices: The president, academic Vice President, C&O vice president. and activities vice president. These four will be voting members of this body. All actions taken by the Executive Council must be upon recommendation and approval of the president. A controller and an executive secretary shall be appointed to this Council, but shall have no voting privileges. · • Section 5--Duties of the activities vice president: The primary responsibility of the activities vice president is to oversee all SUUSA activities. S/he shall also appoint members to the Student Activities Board in consultatioh with the president. S/he shall conduct the affairs of the Student Activities Board (see Section 8). In case of temporary abs~nce of the president, academic vice president, and C&O vice president, the activities vice president shall act as president. • Section 8-The Student Activities Board (STAB) : The primary duty of STAB shall be to organize and carryout social activities and any -other activities deemed necessary for the effective operation of SUUSA . Members of STAB shall in no way be limited to a fixed number of members . Members of STAB shall have the authority to choose assistants and organize committees upon approval of the activities vice president, in accordance with Article V Section 5. • Section 9-Succession : In case of a vacancy in the office of the president, the academic vice president shall become president. In case of a vacancy in the office of the academic vice president, the president pro tern, of the Senate shall become the academic vice president, and shall appoint a new Senator. In case of a vacancy in the office of the C&O vice president , the president pro tern on the Assembly shall become C&O vice president and shall appoint a new delegate. In case of a vacancy in the office of_ the activities vice president, the president shall appoint an activities vice. president subject to approval by a three-fourths majority vote of the Senate. • Section 10-Duties of the C&O vice president: The primary duty of the C&O vice president shall be to preside over the Assembly. S/he shall enforce all bylaws, policies, and rules established to govern the Assembly and Clubs & Organizations . S/he will over see all C&O activities . and co-ordinate the scheduling of activities with the activities vice president. S/he has the power to freeze funds and call a special committee to investigate any club or organization in violation of bylaws, policies, or rules . In case of temporary absence of the president, and the academic vice president, the C&O vice president shall act as president. Article VII • Section 1-The following shall be the elected offices of SUUSA: The president, the academic vice president, the C&O vice president, the activities vice president, and members of the Senate. • Section 8-The election of the Assembly Delegates is to be held during the three weeks following the general elections. • Section'9-Delegates of the Assembly will be elected by club members from within their C&O category. All Assembly Delegates must then be approved by the Senate before taking office. Delegates may be removed from office following the procedur1:1 outlined in Article VIII Article VIII: • Section 3-lmpeachment Committee: As the need arises , an Impeachment committee must be formed . This committee shall consist of: a) the ch ief justice of the Judicial Council, b) president and three vice presid~nts of SUUSA, c) three members of the Senate, d) three additional members of the Judicial Council and e) two delegates of the Assembly . Senate and Assembly of SUUSA. • section 5--The Senate shall have power to ratify , create, revise, and delete any policies that govern the members of SUUSA. • Section 9--AII SUUSA "line item" student fee allocations must be recommended , evaluated and -approved annually by the Senate. A "line item" shall be defined as any annual need of money, as long as the need is not within clubs and organizations. • Section 10-Upon a petition, by 100 members of SUUSA who disagree with a bill passed by the Assembly, Senate may review and revoke the petitioned bill. • Section 12-AII legislative bills shall be kept, and filed for four years . All legislative records are open to inspection by the administration of SUU, or by any member of SUUSA. • Section 13-Both legislative bodies shall have the"' power to establish committees or other appendages to assist in their legislative functions. • Section 16-Unless otherwise provided , both legislative bodies shall conduct themselves under Roberts ' Rules of Order. • Section 17-ln both legislative bodies , a quorum shall consist of at least three-fourths of the voting members. • Section 18-Clubs and Organizations vice president {hereafter referred to as C&O vice president) shall preside over the Assembly, but shall have no vote unless the Assembly is equally divided. Jennifer Powell • Section 19--The Assembly shall have limited • legislative power. These powers are limited to passing bills to adequately govern the clubs and organizations of SUUSA. • Section 20-The Assembly shall be composed of two delegates from each Club and Organization category. The Assembly shall have no less than 4 categories • Section 21-AII Assembly Delegates must be active members of a club-or organization with in the category they represent. The delegates of each category cannot be members of the same club or organization. • Section 22-The Assembly shall elect a president pro tern and shall provide other officers from this body as are deemed necessary. President pro tern shall assume the presidency of the Assembly in the absence of the C&O vice president. • Section 23-The Assembly , alone, shall have the power to appropriate funds allocated to the Assembly. The Assembly shall also have the power to evaluate and/or validate these appropriations. • Section 24-AII bills presented to the Assembly must be sponsored by a delegate of the Assembly. All bills must be circled and posted for review by the Assembly and the member ship of SU USA at least one week prior to a vote by the Assembly. The sponsor of the proposed.bill shall provide a copy of the proposed bill to the Judicial Council. • Section 25-AII bills take effect when passed by a majority vote of a quorum of the Assembly, as defined in Section 17 of Article IV, and upon signature of the president. If the president does not approve of action taken by the Assembly , the president may return the bill to the Assembly with the objections noted . If, after further consideration, the Assembly re-passes the bill by a three-fourths vote of a quorum, it shall then be enacted .
