Show The Utah Statesman Friday March 27 191 Scrutiny of bylaws reveals diverse flaws In an earlier editorial The Utah Statesman took exception with the current set of ASUSU election bylaws labeling them as immoral and probably illegal In that same are so many things editorial we said that cover them all we cannot that these with bylaws wrong in a single editorial’ Now we believe that it is necessary to catalogue those things which we think are wrong with the bylaws Here is a list of those sections which violate the most basic precepts of democratic government accompanied by an explanation of the position of The Utah Statesman on each: Sutton 111 Part A Sumber 7: “Campaigning eta newspapers or radio shall be restruted except as prodded in Section III Part B “ This is a vicarious limitation on the freedom of the press Legal experts consider it illegal to limit a political candidate’s access to the media We cannot but agree Section III Part A Sumber 8: “Unusual devices may be Comemployed for campaigning only by permission of the Elections “ The are? think implicamittee Who we ask do they they tions of this section are awesome This single section smacks of fascism! Section 111 Part B Sumber 2: “Isolations of campaign expenditures will result in a substantial loss of total totes ” We have already explained why this is immoral Notice the use of the word “will” over the more reasonable “may” In short if a candidate goes over the 1120 campaign spending limit he will lose votes A total of 1 percent of his vote total per dollar over the limit And as we have already said it is actually the voter who is being penalized Section Part C Number 1: “A candidate is not allowed to i pent at any public meetings (ie fraternity sorority dorm meeting etc ) prior to April 6 1981 “(italics their own) This is the most obvious violation of the First Amendment in the bylaws No one not even our election committee has the right to limit a person’s right to free speech To do so or to penalize a person for violating this rule is un- m “there “You just fuut to know when to cut USU not for downtown buoine: To the editor: constitutional These bylaws contain many decent intelligent rules The Utah Statesman does not contend that our electoral process needs no regulation We only say that illegal and immoral overregulation is wrong It is our fervent hope that someone will be courageous enough to challenge these incredible rules in a court of law If not then we have all lost part of the battle for our liberties J“!"
