Then EMC was notified Friday, May 8, the day for which another negotiating meeting had been tentatively set, that the union was withdrawing all proposals without giving EMC an opportunity to respond to the union proposals. EMC is not in the BCOA; we are ready to continue negotiations so that we can all return to work. Employees of EMC have the right to hear your management's proposals and make your own comparisons. We recognize the UMWA as the legal, certified bargaining agent of the employees of EMC. Many of your representatives have been working to help make a agreement possible. That seems to reflect the will of the majority of you. However, at this time we have not been given the chance to present any proposals, including the pension program, to the union representatives. We remain desirous of resuming talks with the union representatives and presenting our proposals to them. We acknowledge that we have the obligation to do just that. This letter has been sent to you for informational purposes. Management has taken ALL of the necessary steps to allow us to return to work. The union presented several proposals. It was agreed that another meeting would be held to allow EMC to respond to the union proposals and for EMC to make some counter proposals. The union had presented similar proposals to all local coal companies whose employees are represented by the UMWA. Some companies agreed to some of the proposals. The proposals presented to EMC were similar to those presented to other companies. On Thursday, April 30, 1981, the UMWA District 22 President, Bill Jones, and representatives of the Deer Creek, Deseret, and Wilberg Local Unions called EMC management and said, "We are ready to sit down and negotiate." The first meeting of negotiations was held on Monday, May 4, 1981, at the EMC Training Center in Huntington. The union was represented by the District 22 President, Bill Jones; Wilberg Local President, Grant Smith, Deer Creek Local President, Rick Faccenetti; and Deseret Local President, Lee Hatton; and other representatives. EMC resigned from the Bituminous Coal Operator's Association ( BCOA), a group of coal companies joined together for the purposes of collective bargaining, on April 21, 1981. The company was legally able to do so because (a) the length of the negotiations; (b) the agreement that was voted down; (c) the economic hardship that EMC and its employees are suffering; and, (d) the impasse in the national negotiations at the time of our withdrawa- lall allowed EMC to legally and timely withdraw from BCOA. 8.
