Tenants who reside in he fourplexes south of City Hal here can look forward to light shining from their existing 13 street lights and possibly 12 new street lights to aid them in the dark. The City Council voted to allow the city to step in and assist the fourplex owners in collecting the necessary fees to maintain the street lights and existing purchase 12 more. The bulbs in the street lights standing in the neighborhood now, are unscrewed because some of the buildings owners arent paying the $20 a month to keep them lit. An additional $65 a year per building is required for the new lights. "We need your help in wielding a big stick down on them," said building owner Robert Warren. He said most owners of the 52 buildings are in favor of the lighting improvements, but the unconcerned owners are hindering improvements. What action would you take first if you found water leaking into your basement and a pool forming in your backyard? And it kept coming. Lois Ashby of 3179 South Branden Dr. (4920 West) lives with her family in a home that borders a field where a farmer irrigates using canal water. At times, when the farmer irrigates, an overflow of water seeps into the Ashbys property. The water settled in her yard twice in July and most recently, the last week of August. Who for is responsible correcting the water intrusion, and most importantly who do you call to stop the water immediately before your basement is flooded? Ashby called the citys public works department Friday, Aug. 26. Russ Willardson, the public works department director, sent over a pump. Then the Ashbys looked at the field behind their yard to determine why the excess water took refuge at their house. They confronted the farmer, who rents the land, about the drainage problem and requested that he discontinue irrigating until the water is cleared up. However, the farmer needs to irrigate to prevent his alfalfa from drying up. On Sunday the Ashbys had to call the public works department again for an additional pump because one pump wasnt enough to do the job. "This situation is a constant strain on our family," said Ashby. "We are under a lot of stress." Ashby said she and her husband were up every hour' and a half filling the pumps with gas for five days. Not only did they have to contend with the unrelenting noise the pumps make, but had to sacrifice sleep to feed the pumps, which cost then about $12 a day. "The damage and the costs were to the stress," minimal compa-xd said Ashby. She ' called Brent Mayor Andcison Sunday for his advice and he told her call the city attorney. Monday, Ashby called the city attorney to find out what recourse she had. She wanted to file for an injunction against the farmer in the Third Circuit Court to have the water turned off. She found out she needed to file a complaint first, but to do this one must have the police evaluate the situation and then determine whether a complaint is in order. Ashby then called the police and they were unable to find fault with the farmer and therefore couldnt cite him, and Ashby could not gei. an injunction against him. "The neighbors walk by and gawk at us," she said. The police were back late Monday night because one of the neighbors thought the Ashbys were running their lawn mower and the noise was disturbing them. The pumps produced the noise. "The worst part is the feeling of having no control," says Ashby. The city attorney advised her to call a private attorney because it is a civil matter. Ashby doesnt want to go through the time and money plus the added stress that litigation brings. Besides, she understands the farmers needs, but would just like to resolve the year-roun- nine-mont- h water intrusion in her yard and her life. In the meantime, the Ashbys had to call the public works department again to replace one of the pumps that wasnt working efficiently. The pumps are big. They have a fire hose attached and on a gas engine. You run they cant just go pick one up from the city if you need one. I wish there had been someone to call that would have provided me with all the information to save me the time and frustration." Newman said, "Its a confusing and frustrating matter. If we had clear answers we would regulate the water." With no clear answers and cost being another obstacle, Newman said he doesnt see the situation changing in the future. 'We tell people its between you and the guy using the water, but nobody will take any responsibility. Its not our responsibility, were just trying to help out." A way to help curtail the escaping water is to keep the water drained off the field by keeping the tail water ditches cleaned out and clear so that the water wont sit there and saturate the land, he said. "We have no control over irrigation. The city is not involved.
