RESOLUTION Proposed District Regulation Concerning Liability of the Owner of a Premises for Water and Sewer Rates WHEREAS, service costs to businesses and residential buildings owned by landlords and occupied by tenants are substantially higher than owner-occupie- d buildings; and, WHEREAS, the Districts policy for providing water and sewer service to tenants of apartments and tenements has heretofore been that the individual tenants have entered into the water service agreement with the District on their own behalf and that they, and not the landlord, have been solely responsible for payment to the District of all water and sewer account charges; and WHEREAS, the District has experienced difficulty in collecting water and sewer account charges from tenants in apartments, tenements and other leasehold arrangements who are arrears in payment of their water and sewer account charges; and WHEREAS, pursuant to the provisions of Section Utah Code Annotated, 1953, the Board of Trustees of the District is authorized to do such things and adopt such resolutions as may be necessary to assure the collection and enforcement of all fees and charges imposed by the District; NOW, THEREFORE; be it resolved by the Board of Trustees of the Granger Hunter Water Improvement District that the following regulation be adopted governing applications for water and sewer service to all houses, apartments, tenements, or other residences, buildings, lots, d or places or premises whether wherein the total of said house, building, lot, place or premise or any portion thereof is leased by the owner to a tenant or tenants, as follows : WATER AND SEWER RATES OWNER OF PREMISES LIABILE CoP" kindergarten; third The event is open to the public. Granger-Hunte- r Improvement District, which owns and controls a system for furnishing culinary water and sanitary sewer service to inhabitants residing within the boundaries of the District, shall not be required to furnish water or sewer service for use by any house, tenement, apartment, building, place, premises or lot, or any portion thereof, whether such water or sewer service is for the use of the owner or his tenant or tenants, unless the application for these aforementioned services shall be made in writing, signed by such owner or his duly authorized agent, in which application such owner shall agree that he shall pay and be fully responsible for all water passing through the water meter and the sewer services furnished to such house, tenement, apartment, building, place, premises or lot according to the lawful rules and regulations enacted or adopted by this District governing payment of water and sewer account charges. In those cases where application for furnishing water and sewer services shall be made by a tenant or occupant of the owner, solely for the use by such tenant or occupant for his individual leasehold interest and not for the entirety of the house, tenement, apartment, building, place, premises or lot belonging to the owner or leased by other tenants, this District shall require as a condition of granting the same, that such application contain an agreement signed by the owner thereof or his duly authorized agent, to the effect that in consideration of the granting of such application, the owner shall pay and be fully responsible for all water and sewer services furnished such tenant, or any other occupant of the place named in the application, in the event such tenant or occupant shall fail to pay for the same, according to the lawful rules and regulations enacted or adopted by this District governing payment of water and sewer account charges. 2. In case the owner of any of the premises mentioned in paragraph 1, shall fail to pay for water andor sewer services furnished such owner, tenant, or occupant, according to the lawful rules and regulations enacted or adopted by the District governing payment of water and sewer acount charges, the District may cause the water andor sewer to be shut off from such premises and shall not be required to turn the same on again until all arrearages for water andor sewer services furnished, plus disconnect and other applicable charges as set forth in the Rules and Regulations of the District are paid in full. This Resolution shall take effect 30 days from the date of publication in a newspaper published in or having general circulation in the District. The regulation imposed by this Resolution shall apply to all new applications for water and sewer service from the date this Resolution takes effect. DATED this 15 day of October, 1981.
