Utah Scott Matheson Wednesday declared tlooded regions of Utah's Cache and Box Elder counties a state disaster area, making them eligible for state assistance and review for possible federalrelief. Matheson signed a disaster proclamation on the recommendation of the State EmergencySer- vices Board which received preliminary reports from county officials estimating flood damage in excess of $2.5 million. Paul Ross. director of emergency services, said the declaration clears the way for state agencies to provide disaster aid to farmers and more than 200 homeowners whose property was damaged by flood from heavy rains last weekend The action also meansthe state can begin an in-depth assessmentto determine if Matheson should ask President Carter to declare the flooded regions a national disaster area, which would qualify them for federal aid. Realistic Look At Removal of Food Tax Urged SALT LAKECITY (UPI) — Gov. Scott Matheson says leaders of the Republican dominated Utah Legislature are not taking a realistic look at public pressure for removalofthe state sales tax on food. Matheson told his monthly news conference Wednesday the GOP leaders need to face up the fact that the food sales tax repealwill probably be approved by the voters next November, which could put the state in a financial bind if the Legislature also insists on continued property tax rebates. “It’s only realistic to face up to that nowin this legislative session,” said the governer. Matheson, a Democrat, recommended that the tax rebate plan be scrapped by the Legislature in favor of food sales taxrelief. But the GOP leaders havesaid they will stick by their tax program and deal with the results of a food tax referendum next year. A citizens group staged a petition drive whichcollected enough signatures to force a public vote on the food tax repeal. The Legislature rejected the plan last session. Onothertopics, Matheson repeated his criticism of federal government for turning down Utah's application for $13 million in descretionary highway construction money. Utah's application was denied because it got to Washington after the deadline. But Matheson said the statefiled the forms on timein Salt Lake City. Utah Transportation Commissioner Clem Church charged earlier this week that President Carter was “playing good old boy politics” with the highway funds. He said some southern states had received part of the funds even though they didn’t qualify. The governor said he would continue his investigation of why Utah didn’t receive the money, and possibily seek to have the funds restored. NewTrial Studied For Ex-HughesAide SALT LAKECITY (UPI) — Federal Judge Bruce Jenkins has taken under advisementa motion for a new trial for former Howard Hughes aide John Meier, who wasconvicted last summer of obstruction of justice for knowingly submitting forged documents in a civil case. * Attorney James Barber told Jenkins Wednesday he has obtained vital evidence which was in the custody of the U.S. Internal RevenueService at the timeofthe obstructiontrial. The evidence consists of microfilmed documents which show that Meier did not know the documents in question were forgeries when he submitted them in a 1978civil suit between the defendant and Summa Corp., a holding company for the Hughes empire, Barber said. Sumimasuccessfully sued Meier for $8 million which it claimed the former aide ee by fraudulently selling mining claims to Hughes for - many times their true value. In the obstruction of justice case, Meier was convicted of substituting forged memosfor real documents taken from Hughesoffices in Acapulco, Mexico. The IRS microfilm shows the documents in question werealready in the Acapulcofile when Meier obtained it via a memberof the Canadian Parliament, the lawyer argued.
