THE MAN was actually placed under arrest, taken to a patrol car where he was handcuffed, transported to Farmington and booked into the Davis County Jail. During the booking process, he was fingerprinted, had his picture taken, and had an offense report written up on him. AND ALL because he "forgot about the citation he had received a month or so earlier. Does this sound like harsh treatment? A throwback from the German Gestapo? and perhaps things could, and should be different. But first, lets take a look at what transpires in Justice of the Peace, Circuit Court or District Court of MAYBE SO, Davis County. Lets take a case of a motorist who is cited by the Utah Highway Patrol for traveling 70 miles per hour on Interstate Highway 15. THE MOTORIST is given a traffic ticket for the offense and told that he must sign the ticket as a promise to appear in court within 14 days, or sooner if designated as such on the citation. A copy of the citation is submitted to the nearest justice of the peace or circuit court. IF AFTER the designated time, the motorist has not appeared to enter a plea or to pay the fine, a letter is sent by the court to the address as listed on the citation. If the letter is returned as an unknown address, the court will attempt to find an address by other means, even to the extent of searching their own court records for a more recent address of the offender. COURTS WITHIN Davis County have also emphasized that they will often attempt to reach a person who has failed to appear on a misdemea lor charge by telephone and tell him of the seriousness of not appearing for a court date.
