No. You are exchanging a Quit Claim Deed for a water stock cer- -' tificate. This will separate the land from the water and you will have the deed for your land and the water stock certificate for your water right. ' I - ; ; 2. Why should not Manti City, rather than Manti Irrigation Corn pany, have control of the water? A local water user is in such a minority In the Manti Irrigation Company that the farmers can make all the decisions. The water rights in Manti are vested in the property owners. This was done by virtue of the Cox decree. The only water that Manti City owns is a small water right specified in the Cox degree and it amounts to 1.276 cubic feet per i' I ! I second; therefore Manti City is not a bonafide representative of the water rights within Manti City. The reason the water rights are vested in the property owners in Manti City is because the City Council was in the process of forming the Manti Irrigation Company at the time the Cox decree was being written. Rules governing irrigation companies in Utah prevent these companies from selling off water rights of stockholders unless assessments are not paid. Even in such cases, the water cannot be taken out of the Gass A city lot designation. The Manti Irrigation Company was formed to distribute the water, not to dictate how and where the water is used. It was formed in the 1930s because the Council did not want to concern itself with irrigation matters. Will the new system allow us to cover up the ditches and landscape in front of our properties or will we still be required to maintain the ditches? The small ditches which serve the blocks will be eliminated and the property owners can fill them in and landscape. The creek through the center of the City will remain, as will the flood channel which crosses under Main Street between 3rd and 4th South. Other ditches which will have to remain include the one going west on 4th South, West on 1st South and West on 1st North, and North on 1st West.
