City has responsibility To the Editor: Officials of the City of Ephraim and Ephraim Irrigation Company officials have been having misunderstandings since the new city council members were elected. They have placed "Dirty Problem" articles in the newspaper which the Irrigation Board members do not like and feel are unnecessary. The Irrigation Company and the City were together in their operations until 1920 when, to relieve the City of responsibilities, the Irrigation Company was formed. A contract was made between the City and the Irrigation Company which was called "The Articles of Incorporation. Article 4 of this document states: "The intention of this provision is that the City of Ephraim shall not be relieved of any statutory duty in the control of the water courses leading to the city and within the City of Ephraim in the matter of protecting the lives and property of the people; and provided further that this corporation shall not take control of the city water ditches as now defined by the ordinances of Ephraim City so as to relieve the general fund of the City of Ephraim from the cost or cleanexpense of the semi-annu- ing. Revised Ordinances of the Cityof Ephraim, 1917 Chapter 33, page 147 The City has lost this ordinance and they claim they do not have to abide by the Articles of Incorporation. For many years the Irrigation Company has been willing to clean the ditches and assess the water owners providing the city would haul away the debris. This has worked well. Now the city refuses to do their share unless they are paid for it. We feel a contract should be honored. In the last "Dirty Problems" article Craig Oberg says: "Without proper headgates the Irrigation District was trying to operate their system economically and in many areas sod is used to divert the w atcr. The result is clogged drains under the street. The City is in the process of replacing all grates and welding them in place. They will identify problem areas and deal with it by putting crews and equipment to clean the ditches and document time, labor and equipment. The bills will be sent to the Irrigation District which has the power of assessment will be forced to levy the charges. In the first place the Irrigation District does not build headgates for people. They build their own. The problem Oberg is talking about on Millroad and 4th East was caused by the City and Snow College when they moved the ditch from the south side of the road to the north side. The new council does not know this. Furthermore, the City is responsible for their culverts. The Utah Code says: "Whenever any person, partnership, company or corporation has a right of w ay of any established type or title for any canal or other water course it shall be unlawful for any person, persons or governmental agencies to place or maintain in place any obstructions without first receiving written permission for the change. That the vested rights in the established canals and watercourse shall be protected against all encroachments. The owner of any ditch, canal, flume or other watercourse shall maintain the same, in repair so as to prevent waste of water or damage to the property of others. The City owns the flumes and is responsible for them just as the County and State take care of theirs. Arthur King, President Ephraim Irrigation Company The new Manti Utah Stake Center was dedicated in services held Sunday evening at 6 p.m. The program featured a number of and several musical selections. The stake choir, under the direction of Joyce Henretty and accompanied by Pauline Yardley, sang a variety of numbers suitable to the occasion. Stake President Lee R. Barton presided and Counselor Don V. Tibbs conducted. Speeches were given by former bishops Evan Lowry, Kenneth Howell, and Scott Bean. Bishops Douglas Cox and Douglas Dyreng also spoke, as did Stake Physical Facilities Director Jay Cluff. All were lavish in their praise and appreciation for the many people who had helped make the Stake Center a reality. Mrs. Romania Bird, former Manti resident, also spoke briefly. One of the main features of the building was the pipe organ installed through the generosity of many contributors and financial assistance from the stake. Pres. Barton said that the building and all its contents, as well as the organ, were completely paid for and that the stake was in good financial condition. speakers Pauline Yardley demonstrated some of the capabilities of the organ by playing an arrangement of "The Battle Hymn of the Republic. Leisl Hanson, Suzy Frischknecht and Sherene Beck were among over 150 members from several states attending the conference. The full week included training sessions, workshops, and fun activities. 4-- 4-- Some of the sessions were "Teaching Leadership to Others, "Stress Management," "Celebrate You," "Conflict Busters," Making New Friends, and "The Special Community." The bid shall include the delivery and placement of the coal within the bins as required by the individual schools. The bid price should be guaranteed up through 63088. The bid must directly specify the coal mine or coal mines producing the coal and the price per ton delivered to the schools. The bid must include and meet a minimum of 12,000 B.T.U.s as received (wet) and 12,750 dry. The coal must not exceed a maximum ash content of 9.5 percent as received (wet) and 9.75 percent dry. Sulphur content must not be more than .75 percent maximum. Stake, along with many friends in the Gospel, have gathered here in this newly completed house of worship for the purpose of dedicating it unto Thee. This house is Thy house, Father, and we ask that Thy holy spirit will be here with us that all that transpires will be according to Thy will. We are grateful for this country we live in, for our inspired Constitution, and the right it affords us to practice and belong to the religion of our choice. We love this beautiful valley of Sanpete, and we express appreciation for it and for this great white majestic temple which stands overseeing this valley. We are mindful of the sacrifice of our forefathers who gave their all, even their lives, that this valley might be settled and Thy temple and houses of worship might be built. Our forefathers came from distant lands as they were converted to the gospel, bringing with them their skills and crafts to develop this area and to help in bringing Thy gospel to others. For all of these special people we are grateful. In this beautiful city of Manti and in this, the Manti Utah Stake of Zion, we are most grateful to have this new beautiful Stake Center with all of its modern conveniences to do as Thou hast commanded us to do to begin to perfect ourselves and to prepare ourselves for eternal life and exaltation. Father, bless this stake center that it might stand and be unmarred from the ravages of nature. That the elements will be tempered, that the brick, masonry, timbers, and all that it comprises will remain intact and be preserved to serve Thy desires and our needs as we serve Thee. Because of the many uses this Stake Center will have, may each function serve whereby the Gospel of Jesus Christ might be taught so that the people of these wards and this stake might learn the Gospel, perfect themselves, and prepare members to go to the temple for their own ordinances and to redeem the dead. May the business that is performed here be under Thy guidance and inspiration. May this beautiful pipe organ echo beautiful notes that will inspire all of us to serve Thee. We give thanks for this beautiful edifice. May it stand as a means whereby within the walls of this building many lives will be changed for good. The baptismal font will afford many the opportunity to be a member of Thy church and participate in Thy Gospel. Genealogy and name extraction work will be done to provide an opportunity for our loved ones who have gone before to have the opportunity to partake of eternal blessings. The technologies Thou hast provided will, through satellite broadcast, provide us with the blessing of being taught and counseled by our prophet and general authorities and other leaders of the church. Father, w e realize that the future of the church, state, and nation rests with our youth who will soon be our leaders, and we ask Thee to inspire all those who lead, teach, and train that Thy influence and spirit will always direct them that young and old alike might live up to Thy expectations and do as Thou wouldst have them do. Bless us as we use this stake center to worship Thee, that we will be reverent in it and respectful to it. We know of Thy great love for us. Father, and we have great love for Thee. I dedicate this stake center to Thee. Wilt Thou accept it and sanctify it for our use that in so doing we will prepare ourselves to live our lives that we might return to Thy presence and be prepared to partake of eternal life and exaltation. This I do in the name of Thy beloved Son, our Lord and Savior, Jesus Christ. Ladies Golf On June 23, a Beat the Pro Tournament was played. Winners in the championship flight were: 1st place, Lysa Billins; 2nd place, Dianne Greenwood. Winners in the Palisade Flight were: 1st place, Phern Campbell; 2nd place, Arlou Edwards. On June 29, the Palisade team played the Spanish Oaks team on their course. The Spanish Oaks team were the winners. On June 30, a Blind Bogey tournament was held. Call 3rd place In Nation for Editors Column in 1981 Five times Best Editors Column by Utah Press Association, including 1985 and 1986! From my Trivia drawer a Trivia drawer. Thats a drawer where I put everything I can find that might give me an idea for a future Trivia column. Material in this drawer continues to grow in volume until finally I cant close the drawer. Its at this point I decide to weed it out. That means I have to either use the stuff in a column or throw it away. This week as I put a copy of this months Lions Club magazine in the drawer, it wouldnt go. So I started to sort through it all. By the time I got to the bottom of the drawer, I had all kinds of tidbits to share with you all of them snitched from some place or other. Some of them are a little too risque even for me. Incidentally Ive changed quite a bit. Some of this material I collected many years ago when I was a bit more daring than I am now. Now that Im in the bishopric I wouldnt dare print some of this stuff that I thought was OK earlier. I know some of you out there think I havent reformed enough while some liked me as I used to be. But you cant please everyone and Im trying to straddle the fence. But enough about me! Heres a clever little item I found about three inches down in the drawer: I have . NOTHING People tend to look down at the word nothing and belittle its importance. However, it can mean life or death, success or failure, joy or sadness. Mountain climbers have died when they stepped on it. Parachutists are upset when they pull the ripcord and it comes out. Farmers have lost their farms when they grew it. Ball players and coaches have lost their jobs when they scored it. Women have been whistled at when they wore it, and many women make a good living when they dance in it. Its also reason for joy when it represents the sum total of your debts. Its what you earn when you do it. I have saved it over the years and now have it in my bank account. I could go on but it will mean nothing. I just want you to be aware as you go through life that when you get some time to relax you should think about this subject. Please do not think that I have been trying to give you a sermon because I have nothing in mind. Dont try to thank me. Its nothing. Not to trivial: If you'll smile at everyone who comes to the Pageant, theyll think this is a pretty nice place and youll feel better about It. Bid opening is scheduled for Special Improvement District Bid opening for a Special Improvement District project has been scheduled for July 22, 1987 at 7:30 p.m., Councilman Larry Cox told the city council last week. The project, if the contract is let, would make improvements to the road and install curbs and gutters on Fifth North from the highway to 2nd West. The project would alleviate considerable problems around Manti High School, Manti Seminary and the Sanpete County Fairgrounds. Councilman Cox also indicated that street repairs would be initiated very soon. He recommended that a method of patching similar to that employed by Enoch Smith & Sons in patching natural gas construction sites. The council agreed that this method should be used. The council also agreed to invest in a roller for street patching. In other council action: Councilman Max Call noted that Melvin Galley, a retired engineer. would be willing to assist Manti City in selected survey work in the city at little or no cost. Mr. Galley would establish street lines, elevations, grades for sidewalks, etc., and perhaps the layout of the new cemetery plot. The fuel tanks located at 5th North have not been used for over one year and the council noted that when such occurs that their usage cannot be in a residential area. The consensus of the mayor and council was that this fact should be communicated to the owners. Mayor Peterson inquired about street cleaning and was informed that Main Street would be washed prior to the Pageant. The council concurred that those who are delinquent in utility bills be allowed to work off these bills in various city projects.
