Show Page 2 Legislature Update - ; - ; : : : : : : v . resume this week. This past week we voted on two importantresolutions. The first dealt with property rights and the second resolution dealt with water rights. Both resolutions asked the Federal Government to respect the rights of States and their traditional water and property rights. The Houscof Representative this last week passed an Bill. This will allow smoking only in Private clubs, beer bars, private hotel rooms and private gatherings. Smoking will be outlawed in all other indoor public places. The Senate will soon be taking up this Bill. This week will be setting next years budget for the Division of Wildlife Resources. The battle to get adequate funding for DWR will be aided by the Governors request for additional funds. I am convinced however, we will need further supplementary funding to save the Experiment Station in Ephraim and to fund the predation costs. This week Ill be welcoming 100 students from Ephraim Middle School and 220 students form Delta Middle School. They will be touring the capital building, observing the House and Senate as we debate, and then Senator Blackham and I will meet with them to discuss the Legislative Process. I imagine they will be interested to know about the school uniform Bill. H.B. 10 increases the liability of parents form $1000 to $5000 if their children are found guilty of property damage. The re- sponsibility of the children to make restitution also had the limits re- moved unless a court finds mitigat--. ing circumstances. This should force parents to assume more direct rc- sponsibility for their children as they will feel it in their pneketbook. Our committee had the gun con-- , trol bill debated before us this past week. Cities like Salt lake City are arguing that they should be able to have as strict a law as they want. I worry that if all the different Cities and Counties adopt their own gun control laws, there will be great confusion in enforcement. Since the Brady Bill" will shortly come into effect nationally I think I will vote against al lowing all these varied gun control" laws to pop up around the state.' The gun control" debate will Farmers need to keep acurate records Good records can help you save money. Just think of keeping your bills and receipts as a part of running your farm. When you get ready to file your tax return, good records will make that job a lot easier. You cannot deduct an expense if you do not know how much it was. If the IRS asks you about anything on your tax return, not having the right receipt can cost you money. For taxes, keep these things in mind: I . Make sure your records show what you arc doing. You also need records to show what you spend for supplies and Friday, February II was Rural Issues Day on the floor of the House of Representatives (Some called it Cowboy Caucus Day). I had two resolutions and a bill considered by the House. These were House Concurrent Resolution 2 and 3 , and House bill 318. HCR 2 is a concurrent resolution of the Legislature and the Governor strongly urging withdrawal of federally sponsored range reforms and calling for increase state input into the development of rangeland reforms and policies. I ICR 3 is a concurrent resolution of the Legislature and the Governor urging the federal government to recognize the primary of the western states in managing their water resources and supporting federal legislation or policy that recognizes that primacy. HB 318 is an act expanding the use of Mineral Lease Funds, creating the Targeted Allocation Fund", providing a phase-i- n process to transfer funds received by the Board of Regents from Mineral Lease Fundsback to the Fund, establishing the use of Fund monies, and appropriating SI 50, (XX) from the General Fund to compensate Higher Education. Both of the Resolutions were passed by the House without debate and with very little opposition. C.C. Foxlcy, the commissioner of Higher Education attended the session with me to show her support for HB 318 and it passed without a single oppos 2. Keep your records. HJR 17 would have corrected the tragic decision made by the 1 979 Utah State Legislature calling for a National Constitutional Convention. I would hope that Statement will again reintroduce, and this lime pass, legislation that would rescind Utahs call for a Constitutional Convention and help take the Constitution of the United States off of the endangered species list. Many Legislators have worked on this Mineral Lease issue for more than a decade and it is good to finally gel it passed. This will be of great benefit to rural Utah. This is the proposed law that will force Mavchck Stores to stop underselling the competition by pricing gasoline cheaper by not allowing credit sales. I personally feel this bill hurts competition and will make all the Maverick patrons pay more if it is passed by the Senate and signed by the Governor. As for a Line Item Veto Amendment, a President could veto good legislation as well as bad legislation that gets tacked onto Bills in congressional negotiations. It would also circumvent the congress by giving the President a greater balance of power that the Constitution was designed to prevent. As for a Balanced budget Amendment, Congrcsscould just raise taxes to pay for their outrageous spending and pet projects, all with OUR money, of course, to balance the Budget. Although every good citizen of the Republic wants Congress to act with fiscal Prudence, history has proven thatcongrcss would sidestep any Con-slitutio- Amendment if they thought they could get away with it. Congress could balance the budget today if they wanted to, with a simple majority (50.1), but they don't. Lets suppose that there was a New constitutional convention, the Constitution certainly authorizes it (Article V), who would set in council and develop the wording for such legislation? Im sure that Ted Kennedy would want to be in on the ground floor and what about Zbigniew Brzczinski, (Founder of the Trilateral Commission and author of Between T wo Ages), Richard Nixon, Jimmy Carter, George Bush (who added close to two trillion to the national debt in four short years), Henry Kisscngcr, Tom Foley, or perhaps Nelson Rockefeller? All of these men arc members or former members of the Council on Foreign Rclations.an organization whose sole purpose is to supplant the constitution with Marxist Doctrine. Oh, and we cant forget about our Rhodes Scholar, Slick Williams Clinton and his sjdckick Al Gore (Cecil J. Rhodes, for whom the Rhodes Scholarship was named, was a 19th Century Englishman who idealized Karl Marx). More important to think about, what is to prohibit the Delegation from completely rewriting the constitution or opening it up to all sorts of Socialist Legislation? The answer is NOTHING. No, the risks is too great to let a Convention happen. Remember, there hasbnly been 6ric Constitutional Convention in the history of the United States, and that was in 1787. The one other way to amend the Constitution, authorized by the Constitution has, with two exceptions, served this Republic well for over two hundred years. However, the answer already exist to Constitutionally force Congress toward fiscal responsibility. The answer is the Constitution itself. A few examples; . 1. Involuntary Retirement: If members of the House of Representatives do not perform as desired, within two years, boot them out of office and try someone that will live up to their campaign promises (Article 1, Section 2, Paragraph 1). Since all spending bills originate in The House, that is the place to begin to set things back to where they should be. 2. Legal Money: Gold and Silver as the Legal Tender of this Republic (Article 1, Section 10, Paragraph 1), or at least United Slates Treasury Notes backed by and redeemable in gold and silver. Constitutional money is much harder to inflate thereby making it stable. (The definition of inflation: an increase in the amount of currency in circulation resulting in a relatively sharp and sudden fall in its value and rise in prices). 3 Abolish the Federal Reserve Bank: Congress and Congress along has the authority to coin and regulate Money (Article 1, Section 8, Paragraph 5). Andrew Jackson, seventh president of the United States, faced with rampant inflation and an enormous national debt in his day, caused by a National Central Bank, call The Second Bank of The United States, that was coming and regulating the Money, is quoted to have told Bankers You are a den of vipers and thieves and by the power of the All Mighty, Ill route you out" and in 1 832 he vetoed legislation that would have renewed the Central Bankss charter. By the end of President Jacksons term in office this young Nation was completely out of debt. The Establishment of a Central Bank was also espoused and championed by another infamous creature in world history by the name of Kari Marz, and is known as the fifth plank of the communist Manifesto. These are just three of a host of ways to force Congress to respond to their constituents, if the Citizenry would just get informed.
