Show 0 6 KIMBALL CASE cast HEARD eight hundred acres of coal lands up near scofield involved experts on both sides give testimony there was concluded in the office of the receiver of the united states land onke yesterday the taking of testimony in a land case involving valuable tracts in carbon county the hearing is 14 being conducted before col at at kaighn the receiver the government is represented by top special ecial agents W L walker and hugh 13 campbell the state of utah which is the defendant in the case is represented by davis of xion zion about two yearb ago the state sold to 0 3 kimball about eight aundra acre of land in townships 12 and 1 13 south and G 6 and 7 east in carbon county thu land was selected by the state as agricultural and grazing land under its grant made matte by the government at the time of the adoption of the enabling act I 1 he governments representatives lave have been inquiring into the character of lands in carbon county very extensively ely and several actions have already been instituted notably the cases against the utah fuel company the sweet entries and the milner entries the latter two of which are now on for hearing before J W christy master in chancery when the government special agents investigated the kimball land they concluded that it was more valuable for coal than for agricultural purposes and so reported to the land ollice in washington ington the commissioners ordered a hearing and that hearing heiring is now concluded the bitne witnesses ses have hae already been examined one by deposition the state has presented as witnesses it nesses C if gibbs a mining engineer who has been connected with some of the big companies in coal land matters and W J kimball who formerly had charge of the union pacific coa coal mines in carbon county and later was connected with the coal mines at Co coalville Coil alville ville the government presented the deposition of prof joseph A taft taff a geological expert whose evidence hasteen has been practically the chief feature of the governments cases in other coal land hearings the state and the government presented other witnesses the land is situated in pleasant valley and is surrounded by coal lands for a long distance it is said it is near the scene of mines and not far distant from the coal camp of winter quarters one of the witnesses for the state testified that the land is worth ten dollars to twelve dollars for grazing purposes the price at which government coal land is sold is from ten to seventy five dollars according to classification therefore it will be seen that the area in controversy is valuable both to the government and to the purchaser from the state |
