Commonly known as ORDINANCE 01-8- Eberhard, Jr., all voting aye. AN ORDINANCE SETTING FORTH THE PROCE- DURE WHEREBY BOARD OF COUNTY COMMISSIONERS By GLEN W. FLINT Chairman THE BOARD OF DAVIS COUNTY COMMISSIONERS MAY DISPOSE OF REAL AND PERSONAL PROPERTY OF THE COUNTY The Board of County Commissioners of Davis County, State of Utah, ordains as follows: WHEREAS, under Utah State Statute, prior to the amendment of 1980, Section 8 UCA, 1953, as amended, required that all surplus County property be sold at public auction at the Courthouse door after thirty (30) days previously published notice; and, WHEREAS, the 1980 Session of the Legislature amended this Statute authorizing the Board of County Commissioners to provide by ordinance, resolution, rule or regulation for the manner in which property shall be acquired and disposed of; and WHEREAS, pursuant to authority of said statute the Board of County Commissioners enacts this ordinance. Section I. The Board of Published in The Weekly flex on June 19, 1980 Davis County may purchase real and personal property outright for cash or may purchase it under an installment contract payable over a period of time to be determined by the said Board. Title to all property purchased by the County shall be held in the name of Davis County. Section II. The said Board may also sell, lease, exchange or otherwise dispose of County property in the manner hereinafter provided as the said Board determines what shall be in the best public interest. The procedure for the disposal of both real and personal property of the County shall be as follows: (A) Items of personal property having a value less than $500.00 shall be disposed of in accordance with the regulations as adopted by resolution of the said Board. (B) All other items of personal property having a value in excess of $500.00 and all real property shall be sold in accordance with the following procedures: (a) Notice shall be published, giving time and place of proposed sale and noting in general the nature of the property to be sold. The notice shall be published in one issue of a newspaper of general circulation in Davis County and the sale shall take place at the time fixed in the notice, which shall be not less than ten (10) days and not more than thirty (30) days after the date of such notice. (b) The said Board shall fix a minimum price for each item to be sold and so instruct the Davis County Clerk. If there is no offer of purchase for at least the minimum price as fixed, the item of property may be withheld from sale in accordance with instructions from the said Board. (c) In the event there is no bidder at the sale for at least the minimum price, and the Board does not elect at the public sale to sell for less than the minimum price, the property may be withdrawn from sale. In the event the property, whether it be real or personal property, is withdrawn from sale; the said Board may sell it in any manner it sees fit. (d) All property sold at public sale shall be by the Davis County Clerk and be sold at the north entrance of the Courthouse. (e) Property shall not be sold to any County official or employee of the County. (f) The Board shall have the right to lease property, real or personal and also exchange property, real or personal, for other properties of similar value as determined by the said Board, without offering any such property at public sale. Section III. The ordinance shall also apply to real property acquired by the County by default of other purchaser at the May tax sale and which property has been struck off and sold to the County by the County Auditor. Section IV. In the opinion of the Board of County Commissioners of Davis County, this ordinance is necessary for the peace, health and safety of Davis County and the inhabitants thereof; therefore, this Ordinance shall become effec- -' five immediately upon its passage and upon being published in accordance with law and a copy being deposited in the office of the Davis County Clerk, Farmington, Utah.
