WHEREAS, the Utah State Eire Prevention Board has prepared and recommended the Utah Municipal and County Fire Prevention Code, 1965 Edition, and the provisions of said Code are appropriate for use in East -- Layton City, and WHEREAS, three copies of said Fire Prevention Code, 1965 Edition, have been filed for use and examination by the public m the office of the City Recorder prior to the adoption of this ordinance. NOW. THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF EAST LAY-TOUTAH: 1. The Utah Municipal and County Fire Prevention Code, Edition, recommended by the Utah State Fire Board, Prevention hereinafter referred to as the Fire Prevention Code, is hereby adopted by reference and made a part of the ordinances of this City, including Appendix A insofar as its provisions relate to the remainder of said Code, and B excluding Appendix 1965 therefrom. 1 References within the Fire Prevention Code to Fire or Department Bureau of Fire Prevention shall mean the Layton Cay Fire Department under contract to East Layton City for fire protection, references to Chief of the Fire Department or Chief of the Bureau of L ire Prevention shall mean the Layton City Fire Chief, references to Inspector shall mean an authorized member of the Layton City Fire Department, references to Municipality shall mean East Layton Cay; references to Corporation Counsel shall mean the East Layton Cay Attorney, and references to Police Department shall mean the East Layton Citv Police Department 1 Whenever the Fire Chief shall disapprove an apphea-tioor refuse to grant a permit applied for, or when it is claimed that the provisions of the Code da not apply or that the true intent and meaning of the Code have been misconstrued or wrongly interpreted, the applicant may appeal from the decision of the Chief to the Fast Layton City Council within thirty (30) days from the date of the dmsion appealed from 4 The Layton Citv Fire Chief, the Building Official and the City Engineer shall act as a committee to determine and specify, after giving affected persons an opportunity to be heard, any new materials, processes, or occupancies which shall require permits in addition to those now enumerated in the Fire Prevention Code. The Fire Chief shall post such list in a n c onspicuous place in his office and distribute copies thereof to interested persons 5. A violation of the provisions of the Fire Prevention Code or failure to comply therewith or failure to comply with a lawful order made thereunder, or constructing or building in violation of any detailed statement or specification or plan suband mitted approved (hereunder, or any certificate or permit issued thereunder shall be a misdemeanor. Each separate violation or shall be a separate offense, and any defect or violation requiring correction or remedy which is not corrected or remedied within ten days shall be a separate offense. 6. The application of the penalty provisions shall not be held to prevent the enforced removal of prohibited conditions or the granting of a restraining order by the court of competent jurisdiction. 7. All ordinances or parts of ordinances in conflict herewith are hereby repealed. 8. Where the provisions of the Fire Prevention Code are inconsistent or in conflict with the provisions of the single permit ordinance heretofore enacted by the City, the provisions of the said single permit ordinance shall prevail. 9. Inasmuch as this ordinance is necessary for the immediate preservation of the peace, health and safety of the inhabitants of the City, its provisions shall take effect immediately upon passage and posting PASSED AND ADOPTFD by the East Layton City Council this 20th day of June, property and unsightly or deleterious objects, structures or disused or abandoned vehicles or injurious or noxious weeds, trash, or garbage; Section 2. INSPECTION OF PROPERTIES- - NOTICE AND REMOVAL: The City Council by and through its representat- ow-ne- not less than ten days from the date of notice, Section 3. FAILURE TO REMOVE, CITY SHALL ABAIF- Upon failure of the owner or occupant to - remove, destroy or eradicate such unsightly or deleterious objects, structures or disused or abandoned motor vehicles or noxious weeds, trash, refuse or garbage, after such notice, the City shall proceed to abate such con- dition bv removal, destruction or eradication. Section 4. COST A LIEN UPON PROPERTY; A COLLECTION: statement of the costs incurred by the City m such removal, destruction or eradication and a demand for payment shall be submitted to the owner or occupant in writing and he shall be liable thereafter and therefor The costs incurred shall be a lien upon the property of the owner or occupant and any property removed or taken into custody by the City pursuant to this ordinance may be sold or otherwise disposed of in satisfaction of such lien, the proceeds being applied first to the cost of sale, second to the cost of removal, destruction or eradication and other city expenses, and the balance, if any, to the owner or occupant. Any unsatisfied costs incurred in the removal, destruction or eradication of any unsightly or deleterious obor jects, structures, disused or abandoned motor vehicles or any injurious or noxious weeds, trash, refuse or garbage may be referred to the city treasurer for inclusion in the tax notice of the property owner or occupant and shall be collected as are other property taxes. Section 5.
