| Show - we : Activists on Trial for By Stephen Hunt Tribune Staff Writer WEST VALLEY CITY — Three nueear-arm- s activists were again on trial Wednesday for apparently deliberately trespassing on Hercules property where motors for the Trident II missile are made Last year three peace activists were acquitted of criminal trespass charges after a three-da- y jury that that included expert testimony about the destructive capability of nuclear weapons and testimony from dqengiants who said they feared death from nuclear holocaust Local peace activists say the trespass actions are part of an ongoing campaign aimed at persuading Hercules to stop making inisvile motors and apply their expertise to production of products The trial began in West Valley 3rd Circuit Court with city prosecutors non-viole- nt non-milita- showing a videotape of the Oct 20 1990 peace demonstration at Hercules and testimony from the police officer who made the arrests The city rested their case after 30 minutes The defense's case which began with testimony from a Hercules engineer and a weapons expert who once worked for Lockheed Aerospace was expected to conclude Thursday with testimony from the defendants Following lant year's trial teary eyed jurists admitted they were touched by the protesters testimony and awed by the destructive power of America's nuclear arsenal Attempting to avert a repeat of that trial and verdict Assistant West Valley City prosecutors Mark Sorenson and Gary Crane this year tried to finesse the defense by reducing the Class B misdemeanor trespass violations to disease organisms in the proposed Life Sciences Test Fa- cility at the Dugway Proving Ground Dr Victor Sidel a professor of social medicine at Montefiore Medical Center and the Albert Einstein College of Medicine in the Bronx New York said he is not calmed by the Army's decision to abandon its earlier proposal to build a level 4 (BL-4- ) aerosol test chamber at Dugway's proposed $14 million biological defense laboratory BL-- 4 is the combination of safety equipment and procedures required when handling diseases for which there is no known cure The Army has said it had no plans to test such deadly organisms at Dugway but wanted the extra facilities as a safety bio-safe- ty precaution Because of the public outcry about BL-- 4 facility the Army has changed it plans and now wants to replace its existing BL-- 3 aerosol test facility BL--3 is the level of safety required for the disease organisms which are approved for testing at Dugway 'If there is anyone who believes that organisms requiting BI4 containment will not one day be tested for 'defensive purposes' of course in such a B13 facility I can offer to sell them several bridges in New York City" said Dr Sidel at Tuesday's public hearing in Tooele on Dugwars proposed new laboratory A second hearing was held Wednesday night in Salt Lake City Ile also challenged the Army's claim that laboratory will be used solely for defensive testing of biological weapons "There is ample precedent for the masking the work of facilities developing and testing biological weapons by calling them 'preventive laboratories The Japanese laboratory which in 1933 was established for developing such weapons was called the 'Epidemic Prevention Laboratory'" he said Dr Sidel warned that uncertainty about the type of testing Twin Falls developed rules - Prosecutors Seek 2nd Try At Suspect in Abuse Case By Vince Horiuchi Tribune Staff Writer Prosecutors say they are waiting to see if they can again prosecute the child sex abuse case of Eugene C Reiners after the Utah Court of Appeals overturned his conviction last month The defendant a cabdriver who allegedly told the victim he was Santa Claus was convicted in March 1989 on charges that he abused a handicapped boy The Court of Appeals overturned the conviction at the end of December after it ruled that the victim's statements to a police detective and social worker were erroneously admitted as evidence in the triaL Meanwhile the Salt Lake County Attorney's Office is waiting to see the written decision from the Court of Appeals to see if the case can be prosecuted again "Right now we're just waiting for the remitter to come down" said Glenn Iwasaki who beads the Special Victims Unit of the Salt Lake County Attorney's Office "A lot of things have to be considered like if the witnesses are still around We're looking at it but no decision has been made yet" Mr Reiners was originally convicted of two counts of sodomy upon a child and two counts of aggravated e sexual abuse of a child all felonies The defendant earlier bad pleaded no contest to a single count of attempted child sexual abuse a third-degre- e felony But when it became clear that he was likely to go to prison for the crime the defendant withdrew his plea and opted to go to triaL According to court records Mr Reiners was a cabdriver known as "Santa Claus" who would drive a number of young children to a school for the handicapped during the 1986-3- 7 school year One of those children was the alleged victim called JK in court who was visually impaired In February 1287 JK's mother noticed evidence of abuse according to records He was examined at Primary Children's Medical Center and he later spoke to a police detective and social worker from the hospitaL On direct examination before the jury JK said the defendant would "take him to the North Pole" where he and three other adults would allegedly engage JK in several different forms of sexual games During a series of interviews with the detective social worker and LIC's mother the victim would eng to respond to gage in their questions on what the defendant allegedly did to the victim statements by Those
