Show ‘ i ‘5 * % NORTHERN UTAH 8B Sunday, June 30, 1996 Utah Bar alleges misconduct against attorney between August 1993 and July 1994. The moneyinstead covered Spafford's salary and law firm bills, according to a memorandum supporting the motion for interim suspension filed in 3rd District Court. Spafford also allegedly “robbed Peter to pay Paul” by giving settlements he received on behalf of someclients to other clients, whose settlements had been misappropriated in the past, the memosaid. The practices resulted “in devastating and irreparable harm to clients and has inflicted great harm to the legal profession and the administration of justice in Utah,” according to the complaint. The Associated Press SALT LAKE CITY- The Utah State Bar has filed nine new counts ofalleged misconduct against attorney Earl S. Spafford, who described the action as “thesilliest thing I’ve ever seen.” Officials want a judge to temporarily suspend Spafford’s license to practice law until a trial settles the case. But Spafford, who said the counts have “no merit to them,” has filed a response ask- ing a judge to strike them. The bar accuses Spafford offailing to safeguard more than $280,000 that should have gone to clients for personal injury settlements Spafford’s attorney, Jerry Mooney, said none of the 28 clients named in the most recent complaint was represented by Spafford. Instead, he said, they worked with Lynn Spafford, Earl's son and partner who resigned from the bar two years ago amid allegations involving the mishandling of firm finances. The bar’s filing last week was the third set of charges against Earl Spafford following his son’s resignation. He first was accused of seven incidents of misconduct in April 1995. The bar added five more counts last January after learning that several firm records had been destroyed, said Stephen R. Cochell, chief disciplinary counsel for the Utah State Bar.
