Show agreed that if all property owners on the street in question (100 East Street) sign a document assuming responsibility for the street improvements and releasing the City of any obligations and costs that was FILLMORE CITY COUNCIL MINUTES Minutes of the regular meeting of the Fillmore City Council held Wednesday, April 16, 1980. at 7:30 p.m. in the Fillmore City Building. Notice of time, place, and agenda of the meeting were provided THE PROGRESS, the Gazette, Radio Station KNAK, and each member of the governing body by mailing copies of the Notice and Agenda on March 28, 1980. Those present for the meeting were: Mayor Mark Paxton, Council members Robert Nielson. Doris RasmusDuane sen. Baugh, James Cox. Don Stuart. Carol Recorder Wise, Attorneys Jay V. Barney and David H. Day. Meeting was called to order by Mayor Paxton at 7:30 p.m. Mr. Dick Stam and Mr. Wade Foster presented a new plumbing material which they reported is appropriate for use in home building and Mr. irrigation system. Stam demonstrated the ease with which plumbing connections can be made with the plastic material. Minutes of the April 2 and Special Meeting of April 9th were approved. Motion by Councilman Cox, seconded by CounMotion cilman Baugh. carried unanimously. Bills numbered 5247 through 5334 and 2223 through 2250 which total $126,819.96 were approved for payment. Motion Councilman Cox, by seconded by Councilman Baugh, carried unanimously. The following building permit applications were Motion by approved. A Revenue Federal Use Proposed Sharing Public Hearing had been advertised as required by law and was set for 8 p.m. It was noted at that hour that no interested citizens were present to participate in the hearing. The Recorder explained that in past years revenue sharing funds have been used primarily in police, fire, and landfill maintenance and operation. The City's revenue sharing allocation has been steadily decreasing in amount. The status of these funds for cities is still under debate in Washington: though it is anticipated that the program will be funded, but may well be an even smaller allocation than the present one. These funds will probablv continue to he used in the main tenance and operation for public budgets safety departments, sanitation and recreation programs during the 1980-8fiscal year in an amount of $21,000.00. Attorneys Barney and Day were present and discussed the Higgins vs. Fillmore City case. An appeal had been filed. 1 After a discussion, motion by Councilman Nielson that the City accept Day & Barneys offer to handle the appeal and authorized them to secure the services of former city attorney Dexter L. Anderson as needed on the case. Minimum cost of the appeal payable to Day & Barney will be $2,500.00. Rate of charges will be $50.00 per hour. Attorney Day reviewed the changes proposed in the Millard County Community Council Interlocal Agreement. A procedure for collection ofdelinquentaccounts was outlined. The industrial revenue bonds for Zions Bank have been reviewed by the attorneys and cost of this will be borne by the bank. The application for a building permit for Saunders Trucks, Inc. for a trucking business office in the industrial park was Mr. Loren discussed. Hansen was present. Questions had arisen with regard to the agreement between Fillmore City. Millard County, and Don H. Smith relative to development and sale of land deeded to Mr. Smith industrial within the park. Motion carried unanimously. A business license for Mercantile Christensen Company was approved on motion by Councilman Nielson, seconded by Councilman Baugh. Vote was unanimous. The meeting was called to order at 7:40 p.m. by Chairman Jim Larsen.
