represented on such uch Zane g gave ve the following ruling on Tuesday December in the Third District Court I will state tat that I had anticipated assistance from a judge from one of 01 the other districts in these th naturalizations naturalizations naturalization tion bIt b it tt the probabilities are now that I shall hall not be able to obtain it These naturalizations interfere more or less lew with the business of ot the court To facilitate the business I think the suggestions of ot the district attorney are ares s proper I will fix from ten fn till halt half past t ten fn every forenoon and from Crom halt half halft past t four till about fi five ve in the afternoon for applications application for naturalization rt t r ru u An alien before the court for natural natural- may inay be conducted with dignity and propriety fairness and impartiality ty 1 I will request the District Attorney or his hiM assistant to appear at the times time I have mentioned an and aid in the ex- ex examination ex examination of applicants and their witnesses This Thin will prevent so many examiners There has haa been a decision of ot this Anderson Anderaon which it has been held after atter quite a protracted and thorough m in t n nearly near two weeks that a member of the Mormon Church in good standing Is ia not a am and suitable person to naturalized that the obligations of a member of that organization to the Church are inconsistent with the obligations of ol an American citizen The Tile court found and adjudged that the Church of Jesus Christ of Latter Latter- Latter day day Saints is i an unpatriotic organization organization organization that to become a member of it and to retain that ellow obligations hip fellowship hip obliga obliga- obligations obligations must be assumed and beliefs and prof professions ions made and conduct re- re required re required in conflict with and opposed to that devotion and attachment and to those duties exacted of a citizen of the government of the United States The government of the United States will not divide its allegiance with any anT other government or any other organization and unless the court is satisfied by the offered that thai the applicant has resided the required time in the T-r T i i i United States that lie be is a man of good moral character attached to the prin prin- principles principles of the Constitution of the United States well disposed to the good order and happiness of ot the same it will not notI admit him but on the other hand if the court is satisfied that any applicant having the other qualifications and residence is of sufficient intelligence to under understand tand the principles of the government is well disposed tows towa s sit it is of good moral character to the principles of the Constitution t twill will admit trim turn But this Court having held that the Mormon Church is an organization of such a character that t membership and fellowship in it disqualifies an allen alien for tor citizenship for the present at least the Court will respect that opinion The purposes and aud character of the Church taint and characterize all of its members and disqualifies them for tor citizenship according to the judgment of the Court its members must be re- re regarded retarded re regarded as precluded for tor the present by y the trial in which it was con con- condemned condemned condemned The Church was not con con- condemned condemned condemned by Judge Anderson on ac- ac account account ac account count of religious faith doctrine or worship but because of ot its moral social and political doctrines and the unlawful practices and conduct that it enjoIns Therefore it cannot be said that the effect of the decision IN is to interfere with religious beliefs or the fJ fi ee exercise of religion In this I do not wish to say that this organization like every other human institution may not nob change but so recently after atter the decision and after the thorough investigation the Court will be governed by the opinion In Inthis Inthis this I do not wish to say that the Court will exclude a man because he has been a member of that Church if it he is not 94 a present a member in good stand stand- standing in ing and in in full fellowship I wish it distinctly c Jy und understood od that man a MOl mon or GentIle that appears before this court shall bE be treated with respect his respect his rights will wll be regarded and he will be treated impartially lly and fairly I make these statements because I do not wish to be misunderstood If any attorney or other person has any sug suggestion estion to make during the examinatIOn of any applicant or his w witnesses they can clin make it to the district attorney t or to his assistants It If everyone is s allowed to participate in these examinations there will be be a tendency to wrangling and the pro pro- proceedings proceedings pro proceedings will become undignified and unseemly So that If It any attorney or 4 other person have any suggestions to tomake tomake tomake make with respect to any applicant or orbis his witnesses they will make makA that sug- sug suggestion
