Show A GRAND JURORS ACT some weeks ago it was announced in the NEWS that the grand jury were examining the city and county records for the past twenty years for some time a committee from the grand jury engaged in this business at the court house and of bourse county clerk john C Q cutler gave ve them every facility and gave them access to all the books vouchers aw and documents that go to make the dincov ery of such an act did not tend w pleasure he chehad phad given no one permission to remove them nor had he any intimation that they were taken and their removal without his consent was a violation of law he immediately set about ascertaining who had purloined the documents and learned that some of them were in the possession ps session of members of the grand jury now in session november 13 he was called before that body as a witness and very properly determined to inform the court of the trick which had been played upon him and in order to bring about this result when he was called before the grand jury he declined to be sworn or testify the grand jurors therefore bad to present the matter before judge zane and for this purpose presented them selves when the following colloquy took place the court Is there any lepor report you wish to make mr Fore foreman manT foreman J T lynch we have a statement to make if your honor pleases yesterday afternoon we ordered a subpoena to be served upon J C cutler clerk of the county court to appear before the grand jury this morning with certain books and papers we wished to examine the subpoena was served and returned mr cutler appeared this morning before the grand jury with books and papers su supposed p ased to be the ones we ordered ant and refused to be sworn and refused to testify before the grand jury without ordea from the court we seem to be at the end of our rope he also refused to give any reason why he would not be sworn and bestif testify before the grand jury and we leire desire some instructions in the matter before we proceed further mr mckay mr cutler is present the cou court rt mr cutler will you come forward please on what ground mr cutler do you do decline to be sworn and testify mr cutler if it please your honor I 1 have been cited to a appear P pear before the grand jury to bring bang with me the books and the papers of the county court and I 1 am unable to do so for this reason the grand jury have been examining the accounts counte ao and the books and papers in the county court some two or three weeks past when they first came down I 1 spoke to them and requested them to put each paper back into the pocket where it belonged yesterday I 1 am informed by the grand jury a portion of them that mr M ives without my consent and I 1 being custodian of the county papers and records and without my knowledge and contrary to the protest protest of some of the grand jury had ad taken some of these papers away where these papers are am now I 1 dont know but I 1 am amin in WE 1 l sifts Sift 9 formed by two members of the 1 grand jury that it was upon their protest that these papers were taken and I 1 am unable to bring all the r papers to the grand jury with me apt rpt I 1 preferred r to make the statement to 60 your honor that as I 1 am unable to bring all the papers in I 1 refused to be worn I 1 am willing to be sworn 1 I wished the statement to be made in open court that I 1 am unable to produce all the La papers pers mr mckay if your honor please the statement made by mr cutler is somewhat ingenious the facts are that a committee of the grand jury have been examining the books and papers at the county court house and in that examination they came across some vouchers which they desired dedred to submit to the whole jury those vouchers were submitted to th the jury eJury the jury have them now r consisting perhaps of some half hal f dozen down vouchers and and it was in conse quence of vouchers which I 1 indicated 1 that there had been some busi down there at the county court house entirely contrary to uw law with a view of investigating the matter they subpoenaed mr cutler to come up here now he refuses to be sworn declines to give any reason and desires instructions from the court we dont care anything about the missing vouchers we hawe the vouchers voucher mr cutler if your honor please I 1 don dont at know how many papers may be missing they admit they have taken some I 1 am willing now to be sworn and testify but I 1 have made this statement in open court the court of course if it becomes necessary for you to examine any other papers w while le you are testifying ing you may ex examine ine them foreman oreman lynch these papers are am in the possession of the grand ju jury now ow me the court I 1 understand you are willing
