| Show JUDGE BLACKBURN RIGHT AGAIN WE the people of provo upon tre satisfactory the ending of the perjury trial which grew out of cases against certain liquor men who were prosecuted for breaches of the sunday law joseph collingston collinston Colli Col aston linston and jacob smith were employed by provo city to detect breakers of the liquor ordinances some of the whisky sellers were caught the two detectives being the principal witnesses for the prosecution As a retaliatory process the whisky men made complaint against the city detectives for perjury on the ground that their testimony in the liquor cases was false hence the trial of Collin stun the whisky men giving suph such evidence as they presumed would convict the defendant of perjury the movement was doubtless intended as a measure of intimidation an attempt by whisky men to run the city of provo fortunately the wind blew in an opposite direction and those who were attempting to override wholesome laws and regulations ions were unable to throw dust into the eyes of judge blackburn or to induce him to take a position against good order and proper city government at the close of the testimony for the prosecution his hii honor promptly announce that there was a failure to make out a case and instructed the jury to render a verdict of not guilty by agreement a similar verdict without trial was rendered in the case cam of jacob smith the other defendant in a certain class of cases came with few exceptions we are of opinion that J judge blackburn is anneo unnecessarily severe but this view does not prevent us from recognizing and acknowledging acknowledge n the fact ac that so some me 6 of f his decisions are excellent when he sustains good order and sound government for instance as in these cases and opposes the rule of whisky he is to be commended |
