Bryner: Daniel Peterson - the defendant appeared at continued proceedings in a felony level criminal information containing one second degree unlaw ful possessionuse of a controlled substance count as well as two additional misdemeanor category' charges. The misdemeanor offenses filed against Peterson included one class A unlawful possessionuse of a controlled substance count and one class B unlawful possessionuse of drug paraphernalia charge. Waiv ing the right to a previously scheduled preliminary hearing in the felony level complaint, the defendant pleaded guilty at arraignment to the second degree unlawful possessionuse of a controlled substance offense along with the class A misdemeanor controlled substance count and the class B drug paraphernalia charge. The court accepted Petersons three guilty pleas before tentatively setting pronouncement of judgment in the defendants second degree felony level, class A misdemeanor category and class B criminal convictions on June 16. Anthony Timothy Ponzini - the defendant appeared to answer a criminal case containing two separate felony level offenses, one second degree unlawful possessionuse of a controlled substance and one third degree obstruction of justice count, as well as three additional misdemeanor category charges. After the defendant waived the right to a previously scheduled preliminary hearing in the criminal information, the district judge bound Ponzini over to answer the second degree felony level controlled substance offense, the third degree obstruction of justice count and all three misdemeanor category charges at felony arraignment in the complaint on May 5. Curtis Andrew Farley - the defendant appeared to answer an order to show cause action filed in a felony level criminal case containing one third degree attempted sexual exploitation of a minor offense. Farley admitted to certain allegations cited in the order to show cause action and the court revoked the probationary period previously authorized in the felony criminal information filed against the defendant. In addition, the district judge terminated Farleys probation unsuccessfully and ordered immediate execution of the indetermiterm in the Utah State Prison originally imposed in nate the complaint before crediting the defendant with any incarceration time already served in connection with the felony level criminal case. Weston W. Woolley - the defendant appeared at continued proceedings in a criminal information containing one second degree felony level unlawful possessionuse of a controlled substance count as well as five additional misdemeanor category charges. The misdemeanor offenses filed against Woolley included one class A unlawful possessionuse of a controlled substance count, one class A unlaw ful possessionuse of drug paraphernalia, one class C unlawfully operating a motor vehicle on a denied drivers license charge, one class C unlawfully operating a motor vehicle without liability insurance coverage and one class C speeding traffic violation. Pursuant to a negotiated disposition agreement in the criminal complaint, the defendant waived the right to trial and Woolley pleaded guilty to the class C misdemeanor denied drivers licence count, the class C no insurance charge and the class C speeding traffic violation. Accepting the guilty pleas on the class C misdemeanor category offenses, the court fined the defendant $750 plus applicable interest and sentenced Woolley to 90 days in the Carbon County Jail. The district judge subsequently suspended the payment of $375 of the designated fine amount and the service of all jail time, on condition the defendant satisfies the balance of the monetary assessment in full as instructed, and placed Woolley on informal probation to the court for one year. In exchange for the defendants guilty pleas on the three class C misdemeanor category offenses, the court granted a motion dismissing the remaining second degree unlawful possessionuse of a controlled substance count, the class A possessionuse of drug paraphernalia and the class A controlled substance charge contained in the felony level criminal case filed against Woolley. The juvenile judge reviewed the teenagers legal rights, ruled that Arellano had intelligently entered the admittance and accepted the defendants guilty plea on the class B contempt offense. Pronouncing judgment in the misdemeanor category case, y the court fined the defendant $270 and imposed a ; detention period in the custody of youth corrections. In conclusion, the juvenile judge stayed the execution of y the entire detention period and instructed Arellano to voluntarily submit to random urine testing in connection w ith the misdemeanor category criminal information.
