Show Page Lack of Control Is Weakness Of Utah Budget Utahs budget system is that a major part of state expenditures is not subA July TIIE JOURNAL C chief weakness of ject to legislative control. k This conclusion was reached in a report released by Utah Foundation, the private, nonprofit tax research organization. The report was the second part of a comprehensive study of Utahs budget system undertaken by the Foundation. According to the study, only about 3 LKc of total state expenditures during the present biennium will be from 1955 legislative appropriations based on reviewed budgets. The report points out, however, that while earmarking (the practice of dedicating revenue sources for particular spending programs) still remains a major problem in Utah, the situation has improved greatly during recent years. The Utah Foundation report mentions that the multiplicity of special appropriation measures introduced and passed by the Legislature greatly complicates legislative consideration of the basic budget in Utah. A total of OS separate bills containing appropriations were introduced in the 1955 Utah Legislature. Of these, 24 were finally enacted into law. A problem therefore exists in coordinating spending ami taxing proposals to avoid commitments in excess of available funds. Unlike the Federal government, deficit spending is barred by the State Constitution. The report states that the legislative branch has a definite responsibility in connection with the budget process; it must make the final determination as to appropriation levels and the imposition of new or increased taxes. Legislative consideration of the Utah budget in the past has been hampered by the lack of adequate staff, according to the study. It warns, however, that there is some danger of duplicating the services performed by the executive budget office and recommends closer cooperation between the executive and legislative branches in budget preparation. The report discusses the steps taken to increase independent appraisal of budgets by state legislatures in other states. A bill introduced in the 1955 Utah Legislature proposed to create a Legislative Examiner of budgets. It was not enacted into law. A factor that has affected budgetary control in the past and may affect it even more in the future is the uncertain legal status of the Department of Finance.
