Show MAGNA TIM ES, THl'HSDAV, APRIL 3, 2 Page 1975 nn , miw DS u u Throughout history sexual emancipation and intellectual freedom have seemed to walk hand in hand, only to produce at the end result degradation and decadence. Just as children either progress or digress from parents examples, we progress or digress according to standards set before us by our elders. We persist in racing from day to day, oblivious to the recorded observations bv past sages, learning nothing. Nobody can tell us what to do. Like stubborn children we make our choices, disavowing the past and ignorant of the future. Pornography and obscenity makes its most prolific appearances during times of intellectual questioning and discovery. However, history has proven that sexual license never led to anything but rot. The Greeks, Romans, Turks, Macedonians decline provides ample evidence for that. Moreover, we are proving it today. I dont care what other people do as long as it doesnt bother me, one may say. But what about the children? Even if they dont come into actual contact with jokes, dirty r words, they will be opaquely affected. pictures, or And w ho draws the line to determine when an adult becomes a consenting adult" as presently set on the eighteenth birthday? The consequences of setting no limits are worth considering Its a foregone conclusion that everybodys opinion differs. Ask 30 persons in a room what their definition of pornography is, and you will get 50 different answers except all will agree that it has to do with sex. Literally, the word comes from the Greek "porne, graplios, meaning harlot, writing. The United States Supreme Court has devoted pages of detailed interpretation to it The most current analysis of pornography, passed and signed into law by the current legislature and governor, is Senate Bill No. 215, sponsored by Karl N. Snow and Carl E. Pettersson, which extracts in parts practically verbatum from the Supreme Court ruling in Miller v. California (majority live concurring, four dissenting; on June 21, 1973. opinion The reason for this redefinition, according to Sen. Pettersson, is that present Utah law has been challenged by the operators of the Gallery Theatre I Salt Lake City) and the Ogden Adult Bookstore as being unconstitutional because it does not meet the Miller guidelines The current enacted definition is: a The average person, applying contemporary community standards, finds that, taken as a w hole, it appeals to prurient interest in sex; (b) it is patently otiensive in the description or depiction of nudity, sexual conduct, sexual excitement, abuse, or excretion; and c Taken as a whole it does not have serious literary, artistic, political or scientific value. SB 23 goes on to increase the criminal penalties for persons convicted of violating the Utah pornography law, and imposes mandatory monetary fines and jail (or prison) sentences. When triers of fact are asked to decide whether the stanaverage person, applying contemporary community dards' would consider certain materials prurient, it would be unrealistic to require that the answer be based on some abstract formulation. The adversary system, with lay jurors as the usual ultimate factfinders in criminal prosecutions, has on the standards of historically permitted triers of fact to draw their community, guided always by limiting instructions on the law To require a state to structure obscenity proceedings around evidence of a national community standard would be an exercise in futility. The question of who will decide community standards will will be set change according to precedent, but we presume it what they to action take concerned against those enough by of a f qel is in violation of better judgement. But implicit in the history of the First Amendment is the rejection of obscenity as utterly without redeeming social importance Justice Burger went on: Under a national Constitution, fundamental First Amendment limitations on the powers of t lie States do not vary from community to community, but this does not mean that there are, or should or can be, fixed, uniform national standards of precisely what appeals to the prurient interest or is patently offensive.
