LAKE COUNTY I nder date of June 19, 1972, Salt I.ake Countv and Kennecott entered into an greement, the principal terms of which provide That the Countv will issue tevenue bonds in a total amount sufficient to finance the ptoject 1 2 That Kennecott would enter into a contract foi the design engineering and installation of the project arrange for the sale of the bonds involved and assure then payment, transfer the ptoject to the County or assign the construction conti act to the County subject to lease thereof bv the ( ountv to Kennecott and transfer thereof from the County balk to Kennecott after payment of the bonds, and reimburse the Countv for dll dnect and indirect costs which may be involved in the issuance of the bonds To assure legality of this Agreement and the issuance of industrial revenue bonds thereunder by the County, a test case was initiated and processed to the I tah Supreme Court which held that the Agreement was valid and1 that the bonds may ptoperly GORDON
