lor the llie equalization of taxes it is an hopoi cant measure and it is to be hoped I 1 tr r the sake of the people of the T territory ellory generally that the governor will not obstruct ita its passage Fol following lowin is tho full text of it as it has been sent to him tor for approval SECTION I 1 be it enacts by the governor and legislative assembly of if the tern term of utah that a terri tern board of equalization of assem ment of territorial taxes is herboy created 2 said board of equalization shall consist of seven persons viz the auditor of public accounts and the probate judges of salt lake utah sanpete San Sau pete beaver weber and cache counties SEC 3 said board of equalization hall meet at the county court house in salt lake city at 12 noon ou on the second monday in april of each year and at their first meeting they shall appoint a chairman chaiem an a and nit secretary from among thair thuir number to act during tae pleasure of the boara A miTo majority minority rity of said board may constitute a quorum to to to do business bec 4 said board of equal bation shall have power to call any county bounty court together to obtain fro from w or by a aid ici ot the same the necessary informs tiou tion examine asses of the year previous iu in order to ascertain the actual and the assessed values of taxable property both real and personal comparing one count with another 5 said board of equalization snail shall prepare a report making such changes changed in the assessed kalua valuation ti on of the different classes of property in any county by increasing or decreasing the same t 10 0 such per cent as they may deem lust just and equitable provided that the county court of any county where the property is pro proposed ased assessed seg to be increased as to its asses assessed valuation shall have due notice to appear by agent and resist such increase if such court so desires bec 3 8 tile the action of said board of equalization on the assessed valuation of the pro property in this territory shall property petty be final and immediately n m bitely after the tae decision of said board the secretary thereof shall give notice to the county court of each county specifying in said notice the action of said board and if changes have been made the rate per cent increase or decrease on the assessed valuation of the different classes of property within the county the said board shall finish their labors and apprise each county court of their final decision asrouch as touch ing the assessment of pronty property in the county on or before the first it day of june in each year SEC 7 on receipt of said notice of the action of the territorial board of equalization each county court shall cause said notice to be entered u upon ltd its records and shall thereupon ada add to or take from the assessed valuation of the differ different eat classes of et property in the county sues budh per lier cent cant as assaid said notice shall designate and thereupon give notice by publication in a newspaper published fa in a the county or if there is no such stich paper then by causing a notice of such change to be posted in some public place in each precinct of said county of the action of said board the said assessment roll with the additions or dedia deduction aiwas by per as required by the said board shall be the assessment roll ot ol the county to all intents and purposes for territorial taxes provided that the county board oi of equalization shall have the same powers to change the assessed valuation of the property of the individuals they now possess SEC 8 the said bourdot bo arlof equalization shall furnish to the legislative assembly ot the territory within the first two weeks of its session a report of their official doings under this act SEC SF c 9 each member of said board of equalization except the auditor of Public Accounts shall give bonds to the territory orv in the sum of one thousand dollar two sureties for the faithful performance of his duties in accordance cor dance with the provisions of this act which bond and sureties shall be approved by the auditor of public accounts c and the bond shall be filed in his office SEC 10 each member of sid board of equalization except the auditor of public accounts shall receive for his services while actually eng engaged in the work of equalization four dollars per day and his reasonable traveling expenses the auditor of public accounts shall receive his reasonable traveling expenses the same as other members of said board SEC 11 the auditor of public accounts shall audit the bills of the members of said board of equalization for per them diem and traveling expenses and draw his warrant for the amount du due 97 which shall be paid out of the territorial treasury and the sum of two thousand dollars or so much thereof as may be necessary is hereby appropriated for the payment of such bills lor jor the years 1886 and 1887 |
