remains unchanged they wanted guns P J haley was before commis ammis lioner greenman february 14 on a charge of aiding in an attempt to escape fram amm prison the circumstances indicate that there was a plot among a gang of thieves to effect a delivery of some of the fraternity from the penitentiary and the defendant was made a means of communication between those inside of the prison and parties outside mr haley was sentenced about three weeks ago to imprisonment for assault and served 19 days when he was released on sunday he had two canes one fully and another partially covered with braided garse horsehair hair both were from wm marshall and were for andrew J pettit who got out of the penitentiary some time ago having served a term for larceny warden amos suspected something was wrong and cut open the partially covered cane on the inside he found a letter atthe examination this morning capt amos testified to these facosi facts and stated that he be believed the letter was written by wm ana marshall who is in the penitentiary awaiting trial on several charges of horse stealing the letter better was then introduced in evidence as was also a communication sent into the prison by pet tit whose address was given on an the ranes canes as no west first south street the note sent in by pettit reads this to Is ft a cane I 1 want you to make for me make it as near like the one I 1 made for jack as possible J A 0 those are the anitila ini tiala tila I 1 w will 1 11 be out as soon as I 1 can it a for a f friend of mine A J p the concealed letter which was thought to be conveyed note is on thin paper in violet iok ink and the last paragraph and signature were not written by the same person as the first paragraph jas C watson was called to identify the pettit letter which was written on one of his bis bill heads he could not however say sal whether or not it wa was s andrew J pettit Pet tits a writing pettit had bad been in mr Wa watsons office several times and could have robbery captain Amos testimony was continued he said haleys haldys time expired on sunday he had served nineteen days we found the letters when he was coming out they were bidden in a cane covered with horsehair canes are frequently sent out but most of them are wooden I 1 bad heard that an unfinished hair catie cane had bad been sent out and that caused me to suspect then I 1 cut the defendants defendant Js cane open he said it was for andrew pettit and was from wm marshall one cane had a piece of paper wrapped about it but the cane was an old one and I 1 did not think there was i any letter in it the cane I 1 cut open looked to have dav e something wrong with it I 1 believe the defendant knew all about the scheme I 1 dont know who is the author of the note signed jakey but I 1 believe it is wm marshall D N swan testified I 1 am the marshals mar clerk know andrew pettit he has visited the penitentiary several times since his release the last time was ten days or two weeks
