Michael Westfall were heard Tuesday The first was that of Harrison Cly, who is accused on April 17. of killing Richard Frank Lewis-Irwi- n Bryan Jackson represented Cly, and Iron County District Attorney Scott Garrett represented the state The hearings purpose was to discuss preparations for Cly s trial, including jury selection and courtroom setup The first matter Westfall asked the counselors to resolve was objections to the jury questionnaire It is my undei standing that there may be some Westfall said. I problems with the questionnaire, am willing to consider any changes (the counsel) may have Jackson said he did not have any objections and was content with leaving the questionnaire as it was at the time Garrett said his highest concern was that the questionnaire was instructing the jury rather than gathering information. I am concerned that the format of some of these questions may influence the jury rather than simply galheimg their views, Garrett said Westfall agreed to change one question but kept the remainder of the questions in their current form I think these questions help to instruct the jury on the law and are important for them to understand (the law), he said However, if a question is asked of a witness, I hope that they will wait for me to rule vV X JJraiagp Gdcssfs ttirnaDs - on any objection to the question before blurting out an answer Also discussed was whether the defendant would be allowed to wear street clothes during the trial Jackson asked that his client be allowed to not wear handcuffs during the trial and, if possible, wear less obtrusive shackles Garrett and Westfall had no objection to either of these requests Cly is next scheduled to appear in court Tuesday Westfall said he would be willing to hear any motions in this case on Friday if either counselor wanted to piesent them Jesse Simmons was also in court on Tuesday for his conference m four weeks third Keith Barnes, Simmons attorney, and Garrett k continuance in the case both agreed to a Simmons next appears in court Oct. 19 at 1 30 p m. Dunng Grahams hearing, Westfall will hear discussion on two motions One is submitted by the state to consolidate the trials. CQnsolidating trials is a matter of judicial economy, Garrett said We have the same evidence in both cases, and its better that we only make the case once The other motion before Westfall is a motion by Grahams attorney to suppress the amended information, which includes the charges of aggravated murder and aggravated kidnapping pre-tri- two-wee- Student dies; funeral Friday POLICE BEAT Cedar City Police Department Visit DownEast Outfitters Name Brand Clothing at discount prices.
