and nd john taylor for murder were examined yesterday afternoon there being no variation from the account narrated in yesterdays NEWS the names aames of those these testifying were james doney pr george beers and at deputy marshal W WD D hickman athe the first witness for THE DEFENSE was john brunton the justice of the peace who conducted the preliminary examination he mas iwas asked a few q questions relative to that proceeding and was excused william taylor father of one of the defendants testified on the evening of july 8 1887 some one told me that osborne had my knife I 1 went out and asked him for it telling him I 1 did not want any trouble he said he woul dult do doit it that he would die first I 1 then followed him up and he made a jump at me striking me with the handle of the knife and cutting a couple of cashes in my face I 1 must have asked him tor for the knife twenty times or over to mr peters know W D hickman remember having a conversation with him on the ath about the trouble I 1 told him that osborne had knocked me down I 1 did not tell him that I 1 knew nothing about the case I 1 did not need a doctor to attend my wounds george wells te testified stifled I 1 was at the taylor cabin the night of the trouble there were several of us there DRINKING BEER BEBB and having a good time after william taylor was knocked down I 1 saw osborne backing down the canon with a knife in his bandi band and threatening I 1 ran to mageed and tried to borrow a gun un but he would not let me have one an fn in the meantime old man taylor haa had been picked up and car carried ried into the cabin he was unconscious when taylor asked osborne for the knife he replied by saying that h ha would kill an any y s of a b that came near him to mr clarke I 1 went to mageed to get et a pistol because I 1 wanted to defend tend myself I 1 thought I 1 was in danger because he be looked toward me when lie he made that remark I 1 wanted to get away from him had several drinks acquaintance with him was at my bar duncan maginnis testified john taylors reputation is good he is a jalet quiet and peaceable man philip bonds reputation is also good to mr clarke never saw john taylor under the influence ot of liquor d did id not hear of his being thrown out of a saloon about three weeks before t this his occurrence he be patronizes my saloon john gerrans was the third saloon keeper to testify to the reputation of the defendant jobs joba taylor and said that it was good to mr clark I 1 am not acquainted in bingham Bing bam do not know how taylor is regarded there never saw him drunk PHILIP BOND one of the defendants was sworn and testified I 1 was born in cornwall england am 25 years old left england in 1882 went to michigan where I 1 remained two years then went to california came to utah in may 1887 and went to bingham wa was 8 at taylors Tay lers cabin on july 8 we W were ere drinking till about 10 pm p m john taylor and ident outside in a few minutes influence of liquor but the court held that such evidence was immaterial sheriff byart bart testified that the day bond and taylor were indicted bead said he had protested against taylors hitting osborne and taylor said D n him ill fix him to mr dickson I 1 do not remember the date when lie be made the statement he asked to go before the grand jury I 1 paid particular attention to his words the prosecution rested and the arguments before the jury commenced assistant district attorney clarke leading out for the prosecution bond told his story in a strai ward unhesitating manner that convinced his hearers bearers he be was stating the truth its effect connected with that thai of the other evidence will in all probability be to clear him of the charge it places his defendant codefendant co taylor in a bad light however and it is not unlikely that he may be convicted of manslaughter |
