JURY I 1 wed filed into court and answered to their names three of the number being absent george thompson asked to 10 be excused from further duties as a irand juror in consequence of hia pour poor circumstances cum stances the court replied r that it could not release him as it no authority to do so the case of the united states vs WILLIAM H PIDCOCK was then called in response to the command of the judge mr stood up and was asked if he be had anything to say why sentence should not be pissed passed upon him the defendant through his counsel hon P H emerson stated that be e declined to make any promise for the future i in n relation to obeying or disobeying the edmunds law counsel referred to ane fact that mr pidcock had given the government no trouble that he had voluntarily furnished dished all the evidence himself that was necessary for his conviction he was sincere in the practice of what he believes to be THE TRUE GOSPEL he held no of fical eal position in tile the community had formerly been in business in this city but unfortunately had failed he was now aged in very f feanle ee ale helth health aud and would leave his bis family in a very bad condition and for the court then sentenced the defendant to be confined in the utah penitentiary penitent pe iary on the first count for three months on the second four mont mouths lis and on the third six months a total toral of 13 months no fine was imposed mr pidcock was then delivered to the custody of the marchaland Mar was taken to the penitentiary the next case was that of LORIN AKK TAKK T who was arraigned on five indictments on oil each of whick lie he was charged with violating viol aling the edmunds law in relation to cohabitation J N kimball esq ap appeared eared on benalt benali of the defendant ang and moved to quash the indictments on the ground that the first or legal wife was waa not a competent witness against her husband without the consent of the latter or of both parties carlies par lies he argued the matter at considerable length quoting authorities in support of his position at the close of his bis argument the prosecution arose to reply when the court interrupted him and said it was satisfied that the position taken by the counsel fo for r the defense was the correct one and that especially since the examination of this subject in the barnard white ease case the first or lescal legal wife CANNOT BE COMPELLED to appear and testify against her husband in a crimins crimin ij case unless he or both were agreed in the matter the prosecution argued that it had not been shown by the defense that it was on the testimony moDy ot of the birst wile wife that the he indictment was found which he argued must be done before the point desired by the defense could be made mr kimball replied that it was sufficient that the name of the witness was found on the list when the indictment was found which was the case in this instance the witness was summoned without we consent or knowledge of her husband the matter was then taken under advisement until 2 pm J W browning brownin jr familiarly known as CHUB BROWNING BROWy iNOt was examined as to his qualifications as a grand juror he was not a member of the church of jesus christ of latter day saints he was born in the church and was baptized when he was eight years old but had never been a blight or shining 11 light lit gedid redid he did not believe in the tenets odthe of the church believed it was unlawful f ul for a man to live with wita more than one woman in the marriage relation and would enforce the law against polygamy and unlawful cohabitation ile he was accepted HENRY TAVEY was next catechized catechizer catechi zed ile he did not believe in polygamy or that a man had a right to have more than one living and agn wife at the same time he said he never was convicted of a felony and woud would d prosecute and punish those who violated the edmunds law he was accepted and seemed satisfied with his counsel on both sides the hearing was continued till the next session of court which will be some time next week several civil cases of minor importance were disposed of but they are of no special H Cati cannon noll and served a warrant on brother F E A brown and took him to the co court u rt room where he was arraigned on oil a charge of unlawful cohabitation four indictments were found against him time these were read and the court wye gave him until next wednesday july 7 to plead the bonds were placed at two thousand dollars his sureties were hun hon D 11 peery and H S young esq as crushingly ai as the crusaders can make it A SERIOUS ACCIDENT when the narres of the grand jury were called in court this morning among the three absentees was john miller of plain city he came to ogden early this morning and proceeded to the establishment of H M bonda company on fourth street with mr dix to unload some produce mr miller held the lines and t took 00 char charge ge of the team while mr dix unloaded the garden stuff staff the vehicle was a covered wagon the cover wah wab loose aud and was flapped about by the wind and struck against the anies ol 01 the wagon at this the horses becalm startled but by speaking to them kindly mr miller quieted them for some time subsequently mr dix jumped from the platform to fasten the cover when the off horse W was frightened ened the team started to run 0 an and jerked mr miller town down between the p platform I 1 at f rm and the horse he was thrown throw to the ground grodal his bis head and face were badly bruised one wheel ran over his left breast and st shoulder crushing them severely dr john driver was called in and dressed the wounds but thought that no bones were broken although his patient suffered very acutely tie he was placed iu in a carriage and andt taken alcen to his home by rev mr pastor of the episcopal church in this city about 9 this abis morning one of the prisoners who was working on the street made A BREAK FOR LIBERTY he darted off to the west and was followed by an officer who pursued him until he be reached the railroad depot when the runaway dashed through the ticket office and waiting room and was soon lost to sight although to memory I 1 think he will not be very dear it is thought lie he made his way to the brush in the river bottoms where he will conceal himself until nightfall when
