Show AN DECISION the supreme court on the affirmed a decision of a box elder county jury which will go a long way in settling the range disputes that have been and are arc existing between cattle and sheep men we have in box elder county what Is termed a fence law which requires land owners to fence stock out and because of this owners of stock have driven their herds in upon and taken the teed feell and protests of land owners have been answered with threats of violence in case of an interference william jones the plaintiff ein the case is the owner of about 1000 head of cattle and owned four sections of land in the ill northwest corner of box alder county which yas unfenced and upon which he pastured some SOO head of cows during the summer john blythe the defendant Is the owner of head had of sheep and nd against the protest of jones took all the teed feed and bedded and autu putu pastured ed his heap sheep upon the four sections the result being that jones cattle were forced from the range the sheep men had taken the grass tor for years claiming the right to it inasmuch as as the land was unfenced the result being at times that guns have been pulled and shots exchanged bei between een herders gerders her ders A suit was brought in the federal court some 5 years ago by mr air jonesi jones but on account of the wrong action being brot the defendant blythe prevailed and judge marshall partially construed the fence law very strongly against mr jones the result being that the sheep men took license in so much so that the cattle men were obliged to resort to the courts to determine their rights as the fence law haj had not been construed by the supreme court of utah the cattle men employed J D call who brot suit to recover damages fo for r t trespass against on of the sheep m men x n mr blythe who employed INIa Maginn ginni la s corn the case was on trial some 20 days in all the jury returned a verdict for plaintiff for which with the costs will amount to aboud about 1000 the case was appealed to the supreme supreme court the salt lake papers in commenting upon the decision said that many of the disputes existing between cattle and sheep men are settled mr call is to be congratulated upon his victory |
