| Show aud ams ALEXANDER j substitute ua y x the ho house use of april 4 1884 mr alexander from the committee on territories reported the following bill ash aad asa substitute foiw foi foru W E R 40 a bill H R to pr provider cwm tor vor the manner of solemnizing solemn izing M sl the territory of utah and andri JL 6 provide io V ide idd for tild th e recording of certificates of marriages 1 therein und for other purposes read twice referred to the louse house I calendar and ordered to tobe be printed se be it enacted by the senate and how bow iro fro us of representatives 0 the united stapes staja of america in aoa zon congress congress gress gness assembled k I 1 that hat all marriages in the territory ot oi ubah utah shall be solemnized solemnised by an any judge or justice of a court bourt of record justice of the peace minister of t the h e gospel priest griest denomination or preacher i of any religious giogi j secos sects that every person baving an dhority to solemnize marriages 1 shall kee kec keep a record of all ail marriages solemn iced before him and within thirty hirty days f from rom the day of said marriage shall transmit a certificate ot of every marrial marriage e containing both the christian names and surnames I 1 of the persons married to each other to the county recorder of the 1 county in which the marriage took place and if any person shall neglect or refuse ref use to make return of all the marriages marri aces solemnized before him within tile the time above required gired VIred he shall for every eveny ivery offense I 1 forfeit tae the sum suin of five hundred dollars to be recovered with costs by the bounty countr recorder oi or any person who will prosecute for the same by civil action in any court having cognizance thereof sec 3 that the co county anty recorder of each county shall record all an such returns of marriages in a book to be kept by him forthal for that purpose pur poe within ten days after rece receiving lying the f same auie fo for tor which nes hall hali be allowed allow edthe thes thos u of one ono dollar to be paid bythe by the person solemnizing solemn izing said marriage and it 9 such county recorder j shall shail refuse 4 or im neglect to record within that time any such return to he shall forfeit five hundred dollars to recovered rh c with wita costs by any person i w who 0 will prosecute for the same by civil action in any ca court urt having baving havin coq coz thereof sec see 4 that every person who shall solemnize any marria marriage 19 e when one ode oneat of the parties to said marriage marria e has a living wife or husband shall be be deemed guilty of a misdemeanor ands aads aad on coni diction vic tion shall be punished by imprison ment in the county counts jail for a term of 01 not less than six months and lotmore not dorc dort more than twelve months |
