Show commissions FOR LOCAL OFFICERS THERE appears to be a misunderstanding with some of our friends in regard to the necessity of commis alons from the tha governor to officers elected under the jaws of the territory and also in relation to the secretary and his fee for those commissions some of our country seem to be un under der the impression that the secret secretary ary has been requiring officers elect to obtain commiss commissions ions lons simply for the purpose of gaining the munificent sum of one dollar per head hend and that the commis commission a on costing that sum is worthless when received we do not view this matter in that light in the first place the organic act provides that the governor shall commission all officers who shall be appointed to fill offices under the i laws of the said territory this is construed by many good lawyers allce and I 1 cages to cover the whole ground of officials receiving offices under our local laws and their position is not to bo be set aside without something more than a negative or a sneer it is not unreasonable to consider that the intent of congress was to endow the governor with power to commission all ail aitho the local officers we admit that the terms If elected and 19 appointed have a different technical signification but an officer cerii celii election la Is not nolt referred to as his appointment to office and we think there are good reasons for the use of the term in this sense it has been urged by one of our oar coun coon country try tny con eon temporaries that no officers but probate judges and I 1 tices cices of the veaco trace are required by the laws of the tha territory to be commissioned by the governor reference Bele renee rence to the laws will show that the act for the election of pro bate judges does not require them to be commissioned by the governor and that the act not in reference to the election of justices of the peace and constables does require both of these officers to bo be eo bao commissioned dee compiled lawa laws pp ap it should be understood that the secretary has his required no one to obtain a Comm commission lEsion or to pay him a cent it Is the governor that gives the comm leelon the secretary does dees the tho clerical work and affixes the seal bosl of the territory and d 0 0 our local laws give him a fee of on one dollar for this offices ceis cels s a apply tor for these commissions and in issuing them thern and receiving the fee those officials act within the lines of the law and are not open to the tho censure which some have hastily passed upon them it Is a fact too that no one baa haa been beba den danied bed led a who has not paid the fee but it la Is a fact that quite a number have received it payment then tile tiie commission even it not specially required by law in all cases eases Is not altogether worth worthless lebs leBB it is good solid evidence that the person holding it has been elected or appointed to the office of which it is a n certificate in our opinion it 13 worth at least a dollar on that account recount it is also a mistake to suppose that this is the first year when such commissions have been issued to county and pro inot met officers for a long term of ye ts is it has been the practice in some for those omm off meers officers to apply f r and receive commissions from the governor and we vye do not see where aney were in error in doing dofing so now as to the perquisites of the secretary it is well known that his salary is not large and if our friends will take the tro troubie trouble u bie ble to count up tho the number of officials in the territory and tea what the sum amounts to at a dollar a ahead head some of them only being elected every four fourbears noury foury years yearb earb carb and most of the others every two yearb years they will bee eee that the annual amount is a not great and not worth much quarreling about oar opinion is that in these times when advantage may maybe be taken of any technicality technical ty it Js is best to comply with constitutional law in every respect and give it the widest latitude ot of which its irn ird language guage is capable in this case a dollar Is a small amount and being the token and sign and seal of title to an office is a sum bum not rashly or worthlessly extended by any officer elect |
