Anderson said Fnday he will decide early next week whether to uphold a Salt Lake City ordinance banning overhanging signs in the downtown area. Company president Tom Young alleged the ordinance amounts to taking the companys property without due process of law and without fair compensation. Attorneys for the Young Electric Sign Co., 1148 S. 2nd West, and the city argued the question of whether the ordir nance is legal at a court hearing Friday aftertwo-hnu- noon. The sign company filed suit against the city Wednesday charging that the sign law violates their constitutional rights. At the Friday hearing Youngs attorney, Earl Tanwe are comner, said, plaining that the city is reaching its ends at our expense. He said the sign company will be damaged irreparably if the ordinance is enforced and asked the court to issue both a temporary and permanent injunction to keep the city from enforcing the law. City Attorney John Nielsen told the court, it seems curious the plaintiff would wait until three days before the ordinance goes into effect to raise an objection when he had five years to do so. Commission The City passed the ordinance in April 1968, and set a deadline for compliance of May 3 this year. Nielsen called the order to remove the signs which overhang city property a reasonable excercise of the police power of the city. Certainly it is the idea of the Planning Commission that these signs cause a cluttering and are unsightly and should removed, he added. Meanwhile, arguments over the proposed sign amendment will be heard again Thursday at another public hearing. The amendment will be discussed before the City Commission in the Building at 10 30 a m. A hearing on the amendment was held last month, but another was ordered to allow opponents the opportunity to reargue their case. also presented Opponents y their views during a meeting last month with the city Planning and Zoning Commission. The amendment would not affect existing overhanging signs outside of the dowrftown area.
