' The committee, meeting m the State Capitol, briefly considered and then discarded a proposed hill patterned after a tough California law. The legislation approved by the committee was proposed by the State Board of Higher Education. It consists of Drafts A and B, amending present statutes with the aim of dealing with situations such as the sit-iby 80 students and a student-eache- r at the University of Utah last summer The two drafts will be d bills submitamong ted to the 39th Legislature n pre-file- , vylueh convenes As explained t, Durham, Utah next Monday. by G. Homer commissioner higher education, the drafts will provide better definitions of what constitutes campus and also will permit college and university administrators to deal with offenders immediately without waiting for disposition of concurrent court cases. Draft A defines a violation of the act as any willful action which denies to students, school officials, employes or .nvitees (1) lawful freedom of - Tnovement, (2) lawful use of property or facilities, or (3) I lawful ingress or egress to the institutions physical facilities It further provides: If any person upon the campus of a private or state institution of higher education or upon any other facility owned or controlled by the - of governing board of such institution, willfully impedes the , faculty or staff of such institu- tion ir the lawful performance r of their duties, or willfully Jmpedes a student of such in the lawful pursuit of his educational activities that person is guilty of a vio-- . lation of this act. I LACK CITED ! Dr. Durham said it was the r lack of a proper definition of the offense that led to dismis sal of the case of the 81 press. summer. Also, he Utah explained, administrators were stymied in attempting to hold hearings against the 81 because of the fear of the accused that their testimony would be used against them m Sail Lake City court. Draft B is intended tc remedy this by providing that the University testimony given in administrative hearings cannot be used m any criminal proceedings which may arise from the same e ents. The California law, proceeded on the piemise that anyone on a campus was there by special consent winch could be withdrawn at any time. state-owne- Sen. Jenkins also expressed frustration over the fact that the legislature has lost the to apportion funds to the various colleges and universities.
