By Mary Lubben Deseret News medical writer Lack of legislative action to redefine death is "virtually shutting off" the supply of kidneys for transplant, a University of Utah surgeon said today. Dr. J. Gary Maxwell, associate professor of and proponent of a bill defining "brain surgery death- - that failed to pass the 1975 Utah Legislature, spoke at a U. of U. Medical Center surgical grand rounds lecture. Maxwell said there is an increasing trend, both nationally and locally, to use cadaver kidneys rather than kidneys from living related donors for transplants. He said in 1967 some 56 percent of the transplants Were from cadavers. but this had increased to over 70 percent by 1973. Last year at the U. of U., 75 percent of the transplants were from cadavers. "One of the major obstacles:. Maxwell said, -- is the availability of kidneys." He said he hopes to introduce the bill redefining death in the next session of the Legislature, Eight states already define death as irreversible cessation of brain function. he said Traditionally, Maxwell said. laws have looked at death as a fixed momcnt, usually the cessation of heartbeat and breathing. However, he said, "we in the medical profession now look at death as a process, and not all organs die at the same time." Cases have resulted such as one in California in which a lawyer for a man accused of murder claimed his client was not responsible for the death, hot rather the doctor who removed the victims organs for transplant, Maxwell added. He said laws should not attempt to set specific clinical criteria for "brain death," since these change as knowledge progresses, but should recognum that once an individual's brain is dead. he js dead. "Then we can look toward a more adequate supply of cadaver organs for transplant, nGt only kidneys but hearts, corneas, livers and all the others we are called on to transplant nowadays," he said. Maxwell also noted that more kidney transplants itil Grismore began his questions with the year 19tS. when he became invi, lved with agents of the IBS through a disagreement el' how much tax he owed. moved.
