| Show nr ragn to provide ovide for the Elect election lon ion uty attorney mid mia darc pres t weri viti air t t li 8 i gea seg sra SECTION V be i U biache enacted d by the governor and Legi legislative dative assembly of offee the territory of utah utan that at the general election next to be held and biennially bl thereafter thre shail ahall o elected in each county in this ibis territory by tho qualified fled electors thereof a county prosecuting attorney who shall hold hoid old oid his office for two sears years and until his successor or is elected and qualified SEC 2 before entering upon the duties of his office said pro eluting attorney shall lako lake and subscribe an oath and give bonds with sufficient sureties to the people of the county conditional for performance of his duties which bonds shall bo be approved by by tile the probate judge and with the th eath be filed hied juda w with td 1 1 the tho clark of the tile county court of the county for which I 1 0 is elected SEC 4 it shall be the duty of said pi P isec attorney to commence and take charge of prosecutions for of bences fences arising under the law f the territory in the counties lu luc lur r which they are respectively elected and if such pro prosecution elution ution ec is carried to iho district couri by recognizance appeal or otherwise othe fwise mav may aid in conducting the t p on xin ain in such court 6 4 when requested it 11 shall bb the duty of the tin R attorney in their respect respective counties to advise the county court and all other off meers officers of said county and shall represent said county in all suits and controversies where it shall bo be interested S SEC seo EC 5 the compensation gatlon of sald said attorneys shall bo be such as maybe may be prescribed or allowed by the county court of their respective counties bounties either by fixed salary or by fees as in the discretion of rueh hueh court atnay best promote the public interest SEC 6 each of the prosecuting attorneys may appoint a deputy or d deputies e for whose oin official acts he shall be responsible to aid him ili in performing the duties of his hia office SEC 7 the county court for the se several veral counties may appoint a it prosecuting attorney for we the time thile being and until the offida is filled by an election according to the provisions of this act approved february 17 1676 |
