read twice referred to the committee on the judiciary and ordered to bo be printed A BILL FOR THE protection OF IN THE TE TERRITORY OF UTAH AND TOR FOR OTHER PURPOSES be it enacted by the senate and giouse of representatives of the united states of america in congress assembled that any woman now or hereafter holding the relation of spouse or consort and not that of a lawful wife to ta any man who at the time cohabits with another wom worn a as his lihi wife spouse or consort my mry m y flie fijo her petition in the district curt cirt c cart art urt of the district in which she resides asking to bo be discharged from such relation an and d the person to whom she phe p she bears the relation a being made a party thereto and having 11 notice of such proceeding the tile said court may upon due hearing adjudge and decree her ais ois charged discharged and freed from sueh such relation as aforesaid and may adjudge and decree to her the possession and control of her mino minor r child or children together wit with 11 such portion of the estate and property of the said man to whom she field held heid the said i elation relation as shall un der all ill the circumstances be equit able and just for the support of herself and minor child or children and the said court shall cause to be made on the records an all entry of such decree and give to her a declaration of discharge setting forth briefly the substance of such decree and upon the entry of such decree the said woman so discharged 0 shall be a femme sole provided 0 nevertheless that nothing in this section contained shall be construed to have llave the tho effect of recognizing the validity or legal effect of any dual or plural marriage 0 or r to repeal any laws in relation t to 0 divorce and nothing in this act sha shall shail be held to repeal annul or change any filly existing laws against polygamy or bigamy otherwise than as the tilo sameiro same are aro modified in regard to evidence admissible ablo to prove the ald said aid offenses cs by the tiie preceding sections SEC 2 that no alien living in or practicing bigamy or polygamy shall shail be tie admitted to citizenship of the united states and n no 0 p person erson living jiving in or pm practicing teeing bigamy or polygamy shall shail be e entitled n to vote or hold office in any territory of the united states SEC 3 that in all cases casis of election by ballot all tickets must be of pape in size color weight texture and appearance to be furnished by the secretary of the territory and be paid for fo r out of the tile territorial treasury and if it shall be unlawful for any peron pelson per pel son to put any number figure or device upon said ballot whereby any per whom the ballot was given an and any my violation of or attempt to violate this provision shall be deemed and taken to bo be a felony and upon conviction thereof the poison polson so offending may bo be punished by a fine not exceeding five hundred dollars or by imprisonment in the penitentiary not exceeding one year obby or by bot both lisuch sueh such fine and imprisonment in inthe lathe the discretion of the court and at all elections none but citizens of the united states over twenty one years of age and who have resided in the territory four months next p preceding r ecsedi ng and in the county precinct cl ct or election district thirty days d Y s next prior to jho he election 3 shall be qualified quai nied fied to vote SEC 4 that if any person not qualified to vote shall shail vote dote or ommer offer to vote at any ele cle election clion or if any qualified voter shall cast or offer to cast at any election more than one vote for the same officer or officers he shall be deemed guilty of a misdemeanor and shall upon conviction thereof in the tiie district court of the proper district bo be punished by a plue flue ne not exceeding five live hundred dollars or by imprisonment in the penitentiary not exceeding one year or by both such fine and aa imprisonment in the discretion dis e of the court SEC 5 that at any general or special election heidin beldin i ry of utah the election ign precincts tija hall hail ho be d leit at least thirty days before the election the governor united states attorney and secretary of the territory shall have power to appoint one judge and one cleric clerk of election for each election precinct in the territory so estabi established asbed and to establish such additional precincts as may be necessary to secure to the people a free and fair election and to appoint the judges and clerks of election at such additional precincts SEC 6 that the time limited in the third section of the act of the legislative assembly of utah entitled an act prescribing rules and regulations for the execution of the trust created under the act of congress entitled an n act for the relief of inhabitants of cities and towns on the public landsaw lands yap hundred proved roved march eggli eighteen tee hundred and sixty seven approved february seventeenth eighteen hundred and sixty nine in which the rightful owners or claimants of land within cities and towns of said territory are required to file the statement prescribed by said act shall not apply to persons who at the expiration of said limitation i were either infants femme coverts converts insane or in prison but such p persons er shall have one year after the removal of their disability in which to file said sald statement SEC 7 that the following acts and parts of acts passed by the legislative isla tive assembly of the territory of or utah aro are iro lre disapproved and annulled namely an ordinance incorporating the church of jesus christ of latter day saints saint 11 approved february eighth eighteen hundred and fifty one also the act entitled an act for the organization of the militia of the territory of utah approved january fifteenth eighteen hundred and fifty seven and the system of regulations for the present organization 0 nand and government 0 v of the militia of the territory of utah adopted july eighteen 11 aundre hundred U and fifty seven also section three of the act entitled an act to regulate surveyors and surveying approved roved march third eighteen hundred ired and fifty two also section five of the act entitled an act regulating elections I 1 11 approved january third el eighteen eteen hundred and fifty three also aiso section three of the act entitled I 1 an act concerning the property rights of married persons approved february sixteenth ix eighteen bundled and und sev enty two also all resolutions acts or parts granting za to gi individuals associations or corporations the tile possessory right to any portion of the public domains as herding 0 grounds rounds timber rights or wate water r privileges thereon the leon also kil kii all ill act acts 3 incorporating corporal corp cor orating in cities or tow town also all acts providing for the el election by the legislature 0 of auditor treasurer surveyor general and wardens of penitentiary so far as said acts provide for the election of said officers by the tiie legislative assembly of said sald
